HomeMy WebLinkAboutCity of Tamarac Ordinance O-1975-030`` -m p 3 4A • This ordinance proposed bt, Morris Glicksman t1i CITY OF TAMARAC, FLORIDA ORDINANCE NO. �- p AN ORDINANCE, AMENDING ORDINANCE NO. 70-29A OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC, FLORIDA, BEING SECTION 17-3 OF THE TAMARAC CITY CODE; BY PROVIDING ADDITIONAL STANDARDS REGARDING THE PROHIBITION OF DEPOSITING RUBBISH, FILTH, OR POISONOUS DELETERIOUS SUBSTANCE OR SUBSTANCES INTO THE WATERS OF THE LAKES, CANALS, PONDS, DITCHES, AND CATCHBASINS IN THE CITY OF TAMARAC, FLORIDA; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; REPEALING ALL ORDINANCES IN CONFLICT THEREWITII PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, it has come to the attention of the City Council of the City of Tamarac, Florida that certain persons, firms, companies, corporations or associations have been depositing in the waters of the lakes, ponds, canals, ditches and catchbasins in the City of Tamarac, Florida, rubbish, grass cuttings, trimmings, garbage, litter and construction debris; and WHEREAS, the City Council of the City of Tamarac, Florida is further aware that certain persons, firms, companies, corporations or associations are depositing grass cuttings and other material along the streest, the swales of streets or on lawns contiguous to said swales for a period of time sufficient so as to allow same to be blown by the wind or washed by the rain so as to be scattered and to clog catchbasins which results in substantial blockage of the secondary or tertiary drainage system of the City of Tamarac, Florida; and WHEREAS, the City Council of the City of Tamarac, Florida, further concludes that as a direct and proximate result of the aforesaid practice a flood hazard is created in the City of Tamarac, Florida injurious to the public health, safety and welfare 1 • of its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Any person, firm, company, corporation, or association, or the managing agent of any person, firm, company, corporation or association, or any duly elected, appointed or lawfully created officer of the City of Tamarac, Florida who shall deposit, or shall permit or allow any person or persons in their employ, or under their control, management or direction, to deposit in any of the waters of the lakes, ponds, canals, ditches, or waterways within the City of Tamarac, Florida, any rubbish, filth, construction debris, litter, garbage, grass cuttings, or poisonous or deleterious substance or substances liable to affect the health, safety and welfare of persons or fish within the said waterways; or place or deposit any such rubbish, filth, construction debris, litter, garbage, grass cuttings or other material along the streets or the lawns within the city in any place where the same may be washed, blown or infiltrated into the catchbasins which empty into said lakes, ponds, canals, ditches or waterways herein named, shall be guilty of a misdemeanor punishable by a fine not exceeding the sum of Five Hundred ($500.00) Dollars, or by imprisonment for not more than ninety (90) days or both such fine and imprisonment. SECTION 2: All ordinances or parts of ordinances'; in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder thereof as a whole or any part thereof, other than the part declared to be invalid. - 2 - :S SECTION 4• This ordinance shall take effect immediately upon its final passage.
