ORDINANCE NO.���j
AN ORDINANCE REPEALING ORDINANCE NO. 74-39
WHICH PROVIDED FOR THE ADOPTION OF SCI{EDULES
FOR BUILDING PERMIT FEES BY RESOLUTION; PRO-
VIDING FOR THE INCORPORATION OF CERTAIN
PORTIONS OF RESOLUTIONS 74--60, 74-95, AND
74-104 INTO AN ORDINANCE ESTABLISHING A
SCHEDULE OF BUILDING PERMIT FEES; REPEALING
ALL ORDINANCES IN CONFLICT; PROVIDING A
SAVINGS CLAUSE AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Tamarac, Florida,
pursuant to its powers to regulate the zoning and building within
its boundaries, deems it appropriate to repeal Ordinance No. 74-39
which established a schedule of Building Permit Fees by Resolution;
and
WHEREAS, it is further the desire of the City Council of
the City of Tamarac, Florida, to incorporate certain portions of
Resolutions No. 74-60, 74-95 and 74-104 into one comprehensive
Ordinance; and
WHEREAS, the City Council of the City of. Tamarac, Florida,
believes that the consolidation of portions of said Resolutions
into one Ordinance will assist in the orderly administration of
the Building Department for the City of Tamarac, Florida.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That Ordinance No. 74-39 be and the same is
hereby expressly repealed.
SECTION 2: That portions of Resolutions No. 74-60, 74-95
and 74-104 are herein incorporated as follows:

11. Seawall - Bulkhead.:
(a) Permit and construction inspection costs for the
construction of retaining walls and seawalls henceforth
shall be found in Ordinance No. 74-45 of the Code of
Ordinances of the City of Tamarac, Florida, as presently
in force or as hereinafter may be amended; provided,
however, the fee schedule set forth in said Ordinance
shall apply to all construction whether or not said
construction is incident to development of a subdivision.
(b) Repairs - See Section C - Permit Fee based on Cost of Job.
SECTION C: PERMIT FEE BASED ON COST OF JOB.
That prior to initiation of construction, alteration, or addition
to private property within the City of Tamarac, the person, firm
or corporation desirous of performing said construction, alteration
or addition, which does not fall into any of the above listed
categories, or any categories contained in other ordinances, shall
be required to obtain a permit from the Building Department and
upon the taking of such permit shall be required to pay a fee as
follows:

9. Minimum Total Fee
10. The final cost of any or all site improvements shall be
certified by the permittee's engineer or accountant before
the certificate of occupancy is issued, which shall be
accompanied -ny a:n itemized accounting listing unir costs -
SECTION 3: In the event of an emergency requiring immediate
repairs, a person or firm may proceed with such repairs; provided
however., an application for the permit and the payment of appro-
priate lees are made during the first succeeding business clay of
the City Building Department.

SECTION 4: It is unlawful for any person, firm or corpor-
ation to fail to acquire a proper permit prior to the commencement
of any construction, alteration or repair, on or within private
property, and such act is punishable as provided in Section 1-6
of the Tamarac City Code.
SECTION S: Should any section or provision of this Ordinance
or any portion hereof or any paragraph, sentence or word be declared
by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole
or any part hereof other than the part declared to be invalid.
SECTION 6: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed, as of the effective
date of this ordinance.
SECTION 7: This ordinance shall become effective immediately
upon its final passage.
