AN ORDINANCE REPEALING ORDINANCE NO. 71-9 AND AMENDING ORDINANCE NO. 74--3;ESTABLISHING MINIMUM OFF-STREET PARKING AND LOADING REQUIREMENTS FOR THE CITY OF TAMARAC, FLORIDA; ESTABLISHING AND DEFINING OFF-STREET PARKING TOGETHER WITH DESIGN STANDARDS; ESTABLISHING MINIMUM PARKING BAY DIMENSIONS BY ANGLE AND DESCRIBING TYPICAL CONCRETE CURB DETAILS; PROVIDING FOR SPECIFIC USE CATEGORIES RELATING TO OFF-STREET PARKING REQUIREMENTS; PROVIDING A SAVINGS CLAUSE; REPEALING ALL LAWS IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning Commission for the City of Tamarac, Florida has determined the necessity of establishing minimum off-- street parking and loading requirements for the City of Tamarac, Florida, and WHEREAS, said Planning Commission has caused to have been pre -- pared comprehensive proposals from the City Planner to accomplish the foregoing, and WHEREAS, the City Council of the City of Tamarac, Florida is desirous of implementing the objectives as aforesaid. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: Mieiorwai+i6 To achieve the purposes of this ordinance and of the Code of the City of Tamarac, Florida, and to provide for the safety of pedestrians and motorists, the orderly movement of people, vehicles, and goods, and maintaining the public ways, it is necessary to repeal Ordinance No. 71-9 regulations requiring facilities and space for the off-street parking and off-street loading of vehicles in the City and amend the appendix to Ordinance No. 74-3 illustrating typical raised curb standards. SECTION 2: OFF-STREET PARKING REQUIRED 1. Every building , use or structure, instituted or erected after the effective date of this Ordinance shall be provided with off-street parking facilities in accordance with the provisions of this Ordinance for the use of occupants, employees, visitors or patrons. 0 2. Such off-street parking facilities shall be maintained and continues as an accessory use as long as the main use in continued. 3. Whenever a building or use constructed or established after the effective date of this Ordinance, is changed or enlarged in floor area, number of dwelling or rental sleeping units, seating capacity, or otherwise, to create a requirement for an increase in the number of existing parking spaces, such spaces shall be provided on the basis of the enlargement or change. 4. It shall be unlawful for an owner or operator of any building, structure or use affected by this Ordinance to discontinue, change or dispense with, or to cause the discontinuance or reduction of the required parking facilities apart from the discontinuance, sale or transfer of such structure or use, without establishing alternative vehicle parking facilities which meet the requirements of this Ordinance. It shall be unlawful for any person, firm or corporation to utilize such building, structure or use without providing the off-street parking facilities to meet the requirements of and be in compliance with this Ordinance. 5. The off-street parking facilities required under this article shall be located on the same plot or parcel of land such facilities are intended to serve. SECTION 3: INTERPRETATION OF OFF-STREET PARKING REQUIREMENTS. 1. The parking required herein is in addition to space for storage of trucks or other vehicles used in connection with a business, commercial or industrial use. 2. Where fractional spaces result, the parking spaces required shall be construed to be the next highest whole number. 3. Except as otherwise provided, the number of employees shall be compiled on the basis of the maximum number of persons emplojed on the premises at one time on an average day or average night, whichever is greater, -2- 4. The parking space requirements for a use not specifically listed in Section 6 shall be the same as for a listed use of similar characteristics of parking demand generation. 5. In the case of mixed uses, uses with different parking requirements occupying the same building or premises, or in the case of joint use of a building or premises by more than one use having the same parking requirements, the parking spaces required shall equal the sum of the requirements of the various uses computed seperately except that parking requirements for permitted accessory uses in an apartment building, hotel, motel, or motor lodge and containing 100 or more dwelling units and/or rental sleeping units, shall be provided as follows: - One space per 600 square feet of retail, personal services, and/or office floor space; - One space per 5 seats of total, combined seating capacity in public eating and drinking facilities and assembly and meeting rooms for the first 1,000 seats; FiTa - One space per 18 seats of such seating capacity in excess of 1,000 seats. 6. Whenever a building or use, constructed or established after the effective date of this ordinance, is changed or enlarged in floor area, number of dwelling or rental sleeping units, seating capacity or otherwise, to create a requirement for an increase in the number of existing parking spaces, such spaces shall be provided on the basis of the enlargement for change. 7. For the purposes of this Ordinance, Gross floor area shall mean the gross floor area inside of the exterior walls; in hospitals, bassinets shall not count as beds. In stadiums, sport arenas, churches, and other places 09C of assembly in which occupants utilize benches, pews or other similar seating facilities, each twenty (20) lineal inches of such seating facilities shall be counted as one seat for the purpose of computing off-street parking requirments. SECTION 4: DESIGN STANDARDS 1. Minimum Area. For the purpose of this Ordinance, an off- street parking space is a surfaced area not in a street or alley and having a width of 10 feet by a length of 20 feet, (for 900 angle parking), exclusive of driveways, permanently reserved for the temporary storage of one automobile and connected with a street or alley by a driveway which affords ingress and egress for an automobile without requiring another automobile to be moved. The width of a parking space may be reduced to 9 feet if a parking angle of 600 or less is used and the stall is marked by a double line on either side. The length of a parking space may be reduced to 18 feet, provided the space is edged with a curb, (in lieu of wheel stops), for the full width and a 7 foot landscape strip is provided in accordance with figure B set forth in this Ordinance. All parking bays greater than 10 cars in length shall have a forward means for egress. All parking bays less than 10 cars in length without a forward egress shall have a 6 foot wide backup area at the end of the bay. 2. DRAINAGE AND MAINTENANCE Off-street parking facilities shall be drained to prevent damage to abutting property and/or public streets and alleys and paved with a minimum of 8" shell rock or Lime Rock base and 1" of hot Plant Mix, (Asphalt) Type S-I,Bituminous Concrete Surface or equivalent Base & Surface. Off-street parking areas shall be maintained in a clean, orderly, and dust -free condition at the expense of the owner or lessee and not used for the sale, repair, or dismantling or servicing of any vehicles, equipment, materials, or supplies. 3. LANDSCAPING. all off- street parking -4- areas for all uses except single-family residences shall be land- scaped in accordance with the City of Tamarac Landscape Ordinance #74-3. The Beautification Committee shall determine from the landscaping plan submitted, whether the requirements of the Landscape Ordinance have been met. 4. Separation from Walkways and Streets Off-street parking spaces shall be separated from walkways,sidewalks, streets, or alleys by a wall, fence, 6 inch curb or required landscaping. Further, Channelization and division of parking areas within the interior of the parking lot for pedestrian and vehicular traffic shall be accomplished by the use of landscaped areas, with trees, walls, fences, other natural growth or artificial features, or raised curbs. Marked directional lanes and controls, change of grade or other devices to mark points of turn to separate parking areas, shall be used to control traffic movement. 5. Entrances and Exits Location and design of entrances and exits, shall be in accord withthe requirements of applicable traffic regulations and standards. The width of a two-way access way shall be 25 feet. If a third lane is contemplated a raised curb shall separate the two lanes from the alternate direction lane. One way access way widths shall be 15 feet. Intersections to access ways to abutting development, with streets or other vehicular use areas shall have a minimum 45 feet radius. All driveways inter- secting with public streets or alleys shall he elevated at the c6ntin4ous sidewalk crossing the driveway to eliminate private run- off into public right-of-way. 6. Marking Parking spaces in lots of more than 4 spaces shall be marked by painted lines or curbs or other means to indicate individual spaces. Signs or markers shall be used as necessary to ensure efficient traffic operation of the lot. All painted lines, curbs, sign markings shall be maintained in a legible condition. -5- 7. Lighting Adequate lighting shall be provided and maintained in lots of more than 10 spaces* The lighting shall be arranged and installed to minimize glare on property in a residential district. A minimum backup distance of 20 feet is required between the property line and the first stall as shown in the illustration. 4. A minimum distance of 20 feet is required between the right of way line and parallel interior drives. 5. Interpolate for any angles not shown in examples. * Stall must be marked by double lines on each side, otherwise, stall must be 10' minimum width. SECTION 6: AMOUNT OF OFF-STREET PARKING RE UIRED The off-street parking required by this Ordinance shall be provided and maintained on the basis of the following minimum requirements: 1. Residential. A. Sin�zrle-family detached dwelling. 2 spaces. B. Two-family dwelling. 2 spaces per dwelling unit. KA C. Townhouses, duplexes, and multiple family dwellings. Efficiency - 1.25 spaces per dwelling unit 1 bedroom - 1.50 spaces per dwelling unit 2 bedroom - 1.75 spaces per dwelling unit 3 bedroom - 2.0 spaces per dwelling unit 4 or more bedrooms - 2.25 spaces per dwelling unit In addition, 10% of the required amount of spaces shall be designated on the plans and posted on the parking spaces for guest use only. The spaces shall be located at a convenient location to the main entrance and approved by the Planning Commission. D. Rooming, Boardin , or Lod in House- 2 spaces, plus 1 space per rental sleeping unit. E. Dormitories, Fraternities. 1 space per two beds plus 1 space per employee. 2. Commercial. A. Animal Hospital, Kennel or Animal Grooming. 1 space per 300 square feet of floor area. B. Auto Tag Agency and/or License Bureau. 1 space per 50 square feet of floor area. C. Auto Service Station. 1 space per 300 square feet of floor area. D. Auto Sales (new or used). 1 space per 300 square feet of floor area. E. Bowling Alleys. 5 spaces per lane plus required parking for restaurants, lounges, and accessory recreational activities. F. Carry -out Food Services & Restaurant (Food served for consumption on -or off - remises). 1 space per 30 square feet of gross floor area. -7- G. Clinics or Medical, Dental, Chiropractic 6 spaces per doctor or 1 space per 150 square feet of floor area, whichever in greater. H. Commercial Swimming Pools. 1 space per 30 square feet of water. I. Commercial Recreation Without Fixed Seats (except bowling alleys). 1 space per 100 square feet of gross floor area occupied by guests, patrons, occupants, or members. J. Commercial Tennis Clubs. 3 spaces per court. K. Drive -In Restaurants. 1 space per 30 square feet of gross floor area with a minimum of 25 parking spaces. L. Funeral Homes, Mausoleums, Crematories. 1 space per 250 square feet of gross area. M. Furniture, Appliance Store, Machinery. Equipment, Boat, Trailer Sales and Service. 1 space per 300 square feet of floor area. N. Hotels, Motels, and Motor Lodqes. 1.1 spaces per rental sleeping unit, dwelling unit, or suite. O. Laboratories, Medical, Dental, Chemical, Testing. 1 space per 400 square feet of floor area. P. Leased Storage Units, Communit Gara es. 1 space per storage unit, provided that exterior areas adjacent to overhead doors may be utilized for off-street parking as -8- long as an adjacent storage unit is not blocked, or the on -site circulation of vehicles is not obstructed. Q. Offices; Business, Professional, Post Office, Studio, or Banks and Savings and Loan Associations. 1 space per 200 square feet of floor area. '- R. Personal Services, including_, but not limited to barber shops, beautv shops and the like. 1 space per 200 square feet of floor area, with a minimum of 5 spaces. S. Private Clubs, Recreation Centers. 1 space per 200 square feet of gross floor area. T. Public -Private Golf Courses. Playing Courses - a minimum of 75 spaces per course plus additional required spaces for restaurants, bars, and lounge areas, and other indoor or outdoor accessory uses to such golf course as may be required by this section. U. Retail Stores. 1 space per 200 square feet of floor area. V. Restaurant, Cafeteria, Lounge or other establishment for the consumption of food or beverages on premises. 1 space per 30 square feet of gross floor area shall apply for free standing detached buildings. In all other cases it shall be calculated as 1 space per 200 square feet of gross floor area. W. Stadiums, Racetracks, Fair Grounds, Circus Grounds. 1 parking space per 3 seats, or 1 space per 200 square feet of floor area, whichever is greater. X. Theaters and Other Places of Assembly Havin Fixed Seats. 1 parking space per 3 seats. 3. Industrial. A. Manufacturing and Industrial ❑ses,bottling establishments, printing and engraving shops, wholesale stores, laundries and storage buildings._ 1 space per 500 square feet of gross floor area. Ex- terior areas adjacent to overhead doors may be utilized for parking for warehouses and storage buildings only. B. Warehouses. 1 space per 1000 square feet of gross floor area. - --Buildings, - -, ..—_._ ldigs C. Telephone _ and other Buin _, - Housing Automatic or _ - Specialized Equipment. _ Where no customers or patrons are served on the premises, or are permitted to visit the premises. 1 space per 500 square feet of gross floor area. 4. Educational/Institutional. A. Churches, Synagogues, or Temples. 1 space per three seats. Twenty-five (250) per cent of the required parking spaces for a religious purposes may be planted with lawn grass instead of paved, providing that the area shall be adequately irrigated and marked with concrete wheel stops. -- .10 - B. Community Centers, Libraries, Museums, Art Galleries. 1 space per 250 square feet of floor area. C. College, University, including Private Vocational, and Technical Schools. 1/2 space per student, plus 1 space per employee, plus 1 space per 4 seats in auditoriums and other places of public assembly. D. Convents and Cloisters. 1 space per each ten individuals in the building (s) . E. Day Care Centers and Other Pre -School Facilities. There shall be provided at least 5 spaces for transient use, plus one space per 500 square feet of floor area. Such facilities, shall provide a convenient drop-off area adjacent to the building providing clear ingress and egress. F. Elementary and Junior High Schools, Public, private or parochial. 1 space per 2000 square feet of floor area, except for those areas used for public assembly which shall be calculated separately as required by this section, and added to the total requirement. G. Governmental Offices and Services. 1 space per 200 square feet of floor area, plus 1 space per 3 seats in audit- oriums and places of public assembly. H. Hospitals_ 1.5 spaces per bed. 39C 1. Nursinq, Convalescent Homes, Sanitoriums, and other similar institutions for the aced or infirm. 1 space per 3 patient beds and 1 space per 2 employees or staff members. J. Rectory. 1 space for each priest, minister, or rabbi, plus 2 additional spaces. K. Senior Hiqh Schools. 1 parking space for 1,000 square feet of floor area, except for those areas used for public assembly which shall be calculated separately as required by this section, and added to the total requirement. 5. Miscellaneous A. Accessory Use. Parking for accessory commercial and professional uses shall be computed as though they existed separately B. Aaricultural Uses. 1 space per employee on the shift of greatest employment with a minimum of 5 spaces. C. Ambulance Service. 1 space per employee plus sufficient parking for emergency vehicles which are stored or on call at the location. D. Bus or Other Mass Transit Stations. 1 space per 100 square feet of waiting room area. E. Farmers Market. 1 space per 200 square feet of the retail sales area open to the public plus one space per leased stall or stand area. 0.W-C F. Miniature Golf Courses. 3 spaces per hole of play G. Nurseries and Greenhouses. 1 space per employee, plus 1 space per 10,000 square feet of lot area. H. Public and Private Utilit Services 1 space per employee, plus 1 space per 10,000 square feet of lot area. SECTION 7: OFF STREET LOADING I. Off -Street Loading Required. Except as otherwise provided in this Ordinance, when any building or structure is erected, structurally altered to the extent of increasing the floor area by 50% or more,or converted in use, accessory off-street loading spaces shall be provided in accordance with the following schedule: A. For each retail building, department store restaurant, wholesale house, warehouse, repair, general service, manufacturing or industrial establishment, or similar use, which has an aggregate floor area in square feet of: 1. Over 2,000 but not over 10,000 1 space 2. Over 10,000 but not over 20,000 2 spaces 3. Over 20,000 but not over 40,000 3 spaces 4. Over 40,000 but not over 60,000 4 spaces 5. For each additional 50,000 over 60,000 2 spaces B. For each apartment building, hotel or motel, offices or office building, hospital or similar institutions, places of public assembly, or similar use, which has an aggregate floor area in square feet of: 1. Over 5,000 but not over 10,000 1 space 2. Over 10,000 but not over 100,000 2 spaces a8:10 3. Over 100,000 but not over 200,000 3 spaces. 4. For each additional 100,000 over 200,000 3 spaces 2. Interpretation of Off -Street Loading Requirements a. The loading space requirements apply to all districts. b. The loading requirements in this section do not limit special requirements which may be imposed in connection with the granting of Special Exceptions. 3. Desivn Standards a. Size and Location For the purpose of these regulations a loading space is a space within the main building or on the same lot, logically and conveniently located for bulk pick-ups and deliveries. A loading space shall be a minimum of 12 feet in width, by 60 feet in length, and shall be directly accessible from a street or alley without crossing or entering any other required off-street loading or off-street parking spaces. It shall be arranged for convenient and safe ingress and egress by delivery vehicles, both motor truck and/or trailer combination. b. Drainave and Maintenance Off-street loading facilities shall be drained to prevent damage to abutting property and/or public street and alleys and, paved with a minimum of 8" shell: rock or lime rock base and 2" hot Plant Mix,(Asphalt) Type. S-I, Bituminous concrete surface Course or equivalent base and surface. Off-street loading areas shall be maintained in a clean, orderly and dust free condition at the expense of the owner or lessee and not used for the sale, repair, dismantling, or servicing of any vehicles, equipment, materials, or supplies. - 14 - C. Entrances and Exits. Location and design of entrances and exits shall be in accordance with all applicable traffic regu- lations and standards. Where the entrance or exit of a building is designed truck loading and unloading, such entrance or exit shall be designed to provide at least one off-street loading space. SECTION 8: Handicapped parking space. All applicable state and federal laws relating to the dimensions, minimum requirements and location for handicap parking spaces shall be adhered to on all development plans. SECTION 9: "The provisions of this Ordinance and all sections hereof, shall be strictly enforced by the Code Enforcement Officer of the City of Tamarac, or shall be enforced by such other person or persons who may be, from time to time, designated to enforce the provisions hereof by the City Manager of the City of Tamarac". SECTION 10 Should any section or provision of this Ordinance or any portion hereof or any paragraph, sentence or word declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 11: All Ordinances or parts of Ordinances in con- flict herewith are hereby repealed. SECTION 12: This Ordinance becomes effective immediately upon its final passage.
