HomeMy WebLinkAboutCity of Tamarac Ordinance O-1975-039This Ordinance Introduced By: Temporary No.�, I CITY OF TAMARAC, FLORIDA ORDINANCE NO. 3 GiD AN ORDINANCE REAFFIRMING ORDINANCE NO. 72-16 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC, FLORIDA, SAID ORDINANCE HAVING BEEN INADVER- TENTLY DELETED FROM THE CODIFICATION OF ORDINANCES OF THE CITY OF TAMARAC, FLORIDA, BEING AN ORDINANCE AMENDING ORDINANCE NO. 70-8 OF THE CITY OF TAMARAC BY PROVIDING AN EXCEPTION FOR CONSTRUCTION TRAILERS; PROVIDING A METHOD FOR OBTAINING PERMITS; REQUIRING AN APPLICATION FEE; PROVID- ING A SAVINGS CLAUSE; REPEALING ALL LAWS IN CONFLICT; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac, Florida, did on February 28, 1975 pass Ordinance No. 75-11 which adopted a revision and codification of the Ordinances of the City of Tamarac, Florida entitled "The Code of the City of Tamarac, Florida"; and WHEREAS, Section 2 of said Ordinance No. 75-11 did specifically set forth that all Ordinances of a general and permanent nature adopted on final reading and passage on or before July 10, 1974 and not contained in such Code are hereby repealed from and after the effective date of this Ordinance; and WHEREAS, through inadvertence or oversight Ordinance No. 72--16 of the Code of Ordinances of the City of Tamarac, Florida, was not included in said Code of the City of Tamarac, Florida; and WHEREAS, the City Council of the City of Tamarac, Florida, is desirous of reaffirming said Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION l: That Ordinance No. 72-16, inadvertently not included in the Code of the City of Tamarac, Florida, is hereby readopted and reaffirmed. follows: SECTION 2: That Section 1 of Ordinance No. 72-16 is readopted as "(C) That where a builder holding a valid, active building permit desires to place a mobile vehicle or trailer upon the premises as a temporary construction office, he may apply for a six months' permit for such vehicle, upon payment of a fee of $50.00 (Fifty Dollars) and certification of the safety thereof by the Chief Building Official, and providing that such vehicle is licensed by the State of Florida. Such vehicle shall be kept on wheels and shall be promptly removed upon completion of building operations, or upon any cessation thereof for a period of more than 30 days. The Chief Building Official may enter such orders as he deems advisable with respect to the anchoring of the vehicle due to wind or storm conditions, and with respect to sanitary facilities. Any person aggrieved by such order may appeal the same to the Board of Adjustment." SECTION 3: All ordinances or parts of ordinances and all sections of the Tamarac City Code or parts thereof in conflict herewith be and the same are hereby repealed. SECTION 4: Should any section of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a court of competent jurisdic- tion to be invalid, such decision shall not effect the validity of the remainder hereof other than the part declared to be invalid.
