CITY OF TAMARAC, FLORIDA
ORDINANCE NO.1100
AN ORDINANCE AMENDING ORDINANCE
74-3 OF THE CODE OF ORDINANCES
OF THE CITY OF TAMARAC, FLORIDA,
THE SAME BEING SECTION 6-27 OF
THE TAMARAC CITY CODE, PROHIBIT-
ING THE INSTALLATION OF AIR
CONDITIONING UNITS, CONDENSERS
AND/OR FANS ATTENDANT THERETO
ON ALL RESIDENTIAL AND ACCESSORY
ROOF AREAS IN R-1, R-lB and
R--1C RESIDENTIAL DISTRICTS UN-
LESS THE SAME ARE PLACED ON A
STRUCTURAL ELEMENT MEETING THE
REQUIREMENTS OF THE SOUTH FLORIDA
BUILDING CODE, PROPOSED PLANS
ARE SUBMITTED TO AND APPROVED BY
THE TAMARAC BUILDING DEPARTMENT,
AND A PERMANENT OBSCURE SCREEN
IS CONSTRUCTED; REPEALING ALL
LAWS IN CONFLICT; PROVIDING A
SAVINGS CLAUSE; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 163 of the Florida Statutes,
and Ordinances 1-64, 71-33 and 72-6 of the Code of
Ordinances of the City of Tamarac, Florida, have empower-
ed the Planning Commission of the City of Tamarac,
Florida with the responsibility to provide minimum
design standards for residential districts; and
WHEREAS, the Planning Commission of the City
of Tamarac, Florida, has determined that it is within

the best interests of the citizens health, safety and
welfare to amend Ordinance 74-3, Section 5, the same
being Section 6-27 of the Tamarac City Code, regulating
the placement of air conditioning units in detached
single family residential districts.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: Ordinance 74-3 of the Code of
Ordinances of the City of Tamarac, Florida, the same being
Section 6-27 of the Tamarac City Code, is hereby amended

to read as follows:
"All air conditioning units, condensers,
and/or fans attendant thereto shall be
prohibited from being installed on all
residential and accessory roof areas
in R-1, R-1B and R-lC zoning districts,
unless the same shall meet the following
requirements:
1. The proposed air conditioning unit
shall be placed on a structural
element meeting the requirements of
the South Florida Building Code,
Broward Edition.
2. The proposed plans accompanied by
fee, shall be submitted to and
approved by the Tamarac Building
Department.
3. Permanent, obscure screen shall
be placed along all sides of the
unit which is viewed by the public,
the minimum heighth of which shall
be one foot above the top of the
unit.
SECTION 2: All ordinances or parts of ordinances
and all sections of the Tamarac City Code or part thereof
in conflict herewith be and the same are hereby repealed.
SECTION 3: Should any section of this ordinance
or any portion hereof or any paragraph, sentence or word
be declared by a court of competent jurisidiction to be
invalid, such decision shall not effect the validity of
the remainder hereof as a whole or any part hereof other
than the part declared to be invalid.
SECTION 4: This ordinance becomes effective
immediately upon its final passage.
