AN ORDINANCE AMENDING ORDINANCE NO. 74-41 OF THE CITY OF TAMARAC BY AMENDING ARTICLE X, SECTION 10.3 and 10.4 THEREOF, B-1 NEIGHBORHOOD BUSINESS CENTER DISTRICT: AMENDING ARTICLE XI SECTION 11.3 and 11.4 THEREOF, B--2 PLANNED COM- MUNITY BUSINESS DISTRICT: AMENDING ARTICLE VIII SECTION 13.3 and 13.4 THEREOF, B-3 GENERAL BUSINESS DISTRICT, PROVIDING A SAVINGS CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning Commission of the City of Tamarac, Florida has conducted an investigation of commercial ordinances pursuant to the provisions of Ordinance 74-41 of the City of Tamarac, Florida, and WHEREAS, the Planning Commission of the City of Tamarac has determined by its investigation that it would be in the best interest of the citizens of Tamarac to modify commercial property setback requirements. NOW, therefore be it ordained by the City Council of the City of Tamarac, Florida: SECTION 1: Ordinance 74-41 of the City of Tamarac is hereby amended by deleting therefrom Section 10.3 property development regulations, paragraph 2, minimum yard setback requirements, and Section 10.4, special regulations paragraph 4 and 5 thereof, of Article X and substituting therefrom the following: ARTICLE X: B-1 NEIGHBORHOOD BUSINESS CENTER DISTRICT. SECTION 10.3 PROPERTY DEVELOPMENT REGULATIONS 2. Minimum yard setback requirements Front 50 Feet Side 25 Feet Side (corner) 35 Feet Rear 25 Feet EXCEPTION: 1. The minimum interior side or rear setback shall be 50' when abutting a residentially zoned district with a landscaped buffer as provided in Section 10.4 (5) 2. For properties less than one (1) acre: The minimum interior side setback may be reduced to zero (0) feet on one side provided 105 that one of the following conditions exists: 1. No building or structure exists on the prop- erty adjacent to the proposed zero (0) foot setback. 2. The existing adjacent development would abut the proposed zero (0) foot setback. Wherever two commercial buildings are proposed to abut each other, the side access to the rear of the buildings shall be unobstructed for a minimum of 35 feet. The access shall be desig- nated and posted as "fire access lane" and comply with Section 28-16 of the American In- surance Association Fire Code. In addition, roof overhangs shall not extend beyond the property line. SECTION 10.4 SPECIAL REGULATIONS 4. Offstreet Parking and Loading No offstreet parking, loading or outdoor storage area or vehicular drive shall be located within 10 feet of any abutting residentially zoned district. No trash receptacle fixed or mobile shall be located in a required street set -back area or within 20 feet of any abutting resi- dentially zoned district property. Loading zones shall be permitted in the side or rear yard setback. 5. Fences, walls and Land sca ed Buffers, a 6 foot high solid masonry wall (stuccoed and painted) shall be required along any property line abut- ting residentially zoned district property. A ten foot buffer strip on the interior side of such wall shall be planted with shade trees, 8' to 10' high, placed no farther than 25 feet apart, center to center. SRCTTON 2: Ordinance 74-41 of the City of Tamarac is hereby amended by deleting therefrom Section 11.3 property development regulations, paragraph 2, minimum yard setback requirements, and Section 11.4,special regulations, paragraph 4 and 5 thereof of Article X1 and substituting therefrom the following: ARTICLE X1. B-2 PLANNED COMMUNITY BUSINESS DISTRICT SECTION 11.3 PROPERTY DEVELOPMENT REGULATIONS 2. Minimum yard setback requirements. Front 50 feet Side (interior) 25 feet Side (corner) 35 feet Rear 50 feet -2- 107 . 11 EXCEPTION: 1. The minimum interior side yard setback shall be 50 feet when abutting property is in a residential distract with a landscaped buffer as provided in Section 11.4 (5). 2. SECTION 3: Ordinance 74-41 of the City of Tamarac is hereby amended by deleting therefrom Section 13.3 property development regulations, paragraph 2, minimum yard setback re- quirements and Section 13.4 special regulations, paragraph 3 and thereof Article Xlll and substituting therefor the following: ARTICLE Xlll: B-3 GENERAL BUSINESS DISTRICT SECTION 13.3 PROPERTY DEVELOPMENT REGULATIONS 1. The minimum interior side yard setback shall be 50 feet whenever abutting property is in a residential district. The rear setback shall be a minimum of 25 feet when abutting a business zoned district property providing that a dedicated alley exists or is to be dedicated; and further that said requirements adhere to the provisions of Section 13.4 (5). 2. For existing properties less than one (1) acre: The minimum interior side setback may be reduced to zero (0) feet on one side provided that one of the following conditions exists: 1. No building or structure exists on the property adjacent to the proposed zero (0) foot setback. 2. The existing adjacent development would abut the proposed zero (0) foot setback. SECTION 4: Section 5 of Ordinance 74-41 of the City of Tamarac, Florida, is hereby amended by including thereto Section 17.3 amendments to the master List "Gasoline and Oil Filling Stations" with usual Accessory uses - Special Exceptions.* - 4 - 4 c Business Use: B-1 B-2 B-3 Gasoline & Oil Filling Stations with usual Accessory Uses - X* X* Special Exception* SECTION 5: Should any section or provision of this ordinance or any portion hereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not effect the validity of the re- mainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 6: All ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict.
