HomeMy WebLinkAboutCity of Tamarac Ordinance O-1977-001Proposed by: Councilman Tucker Temp. #417 Introduced by: V/M Massaro Revised 10/21/76 Revised 11/22/76 " 1/19/77 " 2/9/77 CITY OF TAMARAC, FLORIDA ORDINANCE NO. #0-77-1 AN ORDINANCE AMENDING CHAPTER 16 OF THE TAMARAC CITY CODE RELATING TO UNNECESSARY DISTURBANCES BY ADDING THERETO AN ADDITIONAL SECTION DESIGNATED AS SECTION 16-8 RELATING TO THE RESTRICTION OF PLAYING TENNIS ON COURTS LOCATED IN THE CITY AFTER 9:30 PM, LOCAL TIME WHEREAS, the City of Tamarac has been developed as a residential community with emphasis on the prohibition of un- reasonably loud, disturbing and unnecessary noises; and WHEREAS, there has been the establishment of numerous tennis courts located in, at, or near residential communities and dwellings; and WHEREAS, it is deemed that the unnecessary noises and lighting glares emanating from the playing of tennis at unreasonable hours of the night are detrimental to the general health, safety and welfare of the residents; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Chapter 16 of the Code of the City of Tamarac be amended by adding thereto the following section: Section 16-8. (a) Restriction of Tennis Playing. It shall be unlawful for any person to engage in, or permit the playing or practice of tennis on a court which is located in this City and close to dwellings or apartments, so that the noise emitted from such games disturb, or are detri- mental to the health, peace and quiet of any occupants thereof, during the night hours after 9:30 PM and the lights illuminating such tennis courts shall be extinguished not later than 9:30 PM, local time. -l- .. 9 �_' (b) Exemption From Ordinance: Any tennis court which is owned or operated by a Condominium Association, a Homeowner's Association, a Golf Club or a Tennis Club are exempted from this Ordinance. (c) In the event that any owner or operator of a tennis court shall furnish proof to the Council that all neighbors within a radius of 300 feet (300) from the tennis court, approve the oper- ation of the tennis court for the evening hours after 9:30 PM, local time then upon such proof the Council .shall exempt by a special exception such tennis court. SECTION 2: Severability Clause. Should any section or provision of this Ordinance or any portion hereof, or any paragraph, sentence, or word be declared by a court of competent .jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part to be declared invalid. SECTION 3: Conflict. All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby re- pealed, as of the effective date of this Ordinance. SECTION 4: Effective Date. This Ordinance shall take effect immediately upon its passage. PASSED.
