CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-77-3
AN ORDINANCE AMENDING CHAPTER 11 OF THE TAMARAC
CITY CODE RELATING TO OFFENSIVE ODORS RESULTING
FROM THE ACCUMULATION AND STORAGE OF GARBAGE BY
COMMERCIAL ESTABLISHMENTS, PUBLIC PLACES, ETC.;
PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac has developed as a residential
community with emphasis on the prohibition of offensive, unhealthy,
and unwholesome odors, and
WHEREAS, there has been a practice for various commercial
or business establishments to store garbage in such a manner as
to be detrimental to the general health, safety and welfare of
persons residing in adjacent residential areas, and
WHEREAS, it is deemed that appropriate provision be made
so as to prevent emanation of such offensive, unhealthy and
unwholesome odors.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That Chapter 11--Section 11-3 of the code of
the City of Tamarac be amended so as to read as follows:
SECTION 11-3. Elimination of Odors From Commercial Establish-
ments. Public Places. etc.
(a) All commercial or business establishments, including but
not limited to restaurants, dining rooms, public markets
butchers, hotels, grocery stores, or any other similar
business where garbage may accumulate, shall provide for
the storage of such garbage in a watertight and airtight
bags of plastic or similar material and that such bags shall
be deposited until collection by the garbage collector in
suitable and adequate dumpsters or containers which shall
likewise be protectively covered until such collection.
Such dumpsters or containers shall be properly screened
and kept no less than fifty (50) feet from the boundary

line of such commercial or business establishment,
or shall be kept at a point which shall be at least
fifty (50) feet from the nearest residential property
or home, whichever is greater.
(b) The dumpsters or containers shall be regularly and
completely cleaned, so as not to emit any offensive
odors.
SECTION 2: Penalties. Any violation of this provision of
the code shall be subject to a penalty for each offense of $250.00
fine or imprisonment of not more than ninety (90) days, and may
subject said violator to revocation of his occupational license.
SECTION 3: Severability Clause
Should any section or pro-
vision of this Ordinance or any portion hereof, or any paragraph,
sentence, or word be declared by a court of competent jurisdiction
to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the
part to be declared invalid.
SECTION 4: Conflict. All Ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed, as of
the effective date of this Ordinance.
SECTION 5: Effective Date.
thirty (30) days after its passage.
This Ordinance shall take effect
