PROVIDING AN EFFECTIVE DATE WHEREAS, the Planning Commission of Tamarac has recommended to the City Council that Ordinance 75-35, an ordinance repealing ordinance 71-9 and amending Ordinance 74-3; establishing minimum off-street parking and loading requirements for the City of Tamarac, Florida, be amended; and WHEREAS, the Planning Commission has reviewed the parking ordinance 75-35 and have determined that it would be in the best interest of the City of Tamarac to amend same; and WHEREAS, the City Council of Tamarac is desirous of implementing the objectives of the aforesaid. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Ordinance 75-35, Section 2, Off Street Parkin Required shall be amended by adding to subsection 4 as follows Subsection 4 Off -Street Parking Required: In no case shall an existing carport or garage on a residential dwelling, which has been included as a portion of the required off-street parking, be converted to enclose storage or habitable space unless equal off-street parking facilities have been pro- vided which comply with subsections 1 and 2 of section 4, "Design Standards", of this ordinance. SECTION 2: Ordinance 75-35, Section 2, Off -Street Parkin Required shall be amended by adding subsection 6 as follows: Subsection 6 Off -Street Parking equired: On all public rig is -of -way in the City parking shall be prohibited between the hours of 2 A.M. and 6 A.M. SECTION 3: Ordinance 75-35, Section 4, Design Standards, Sub- section 1, Minimum area, shall be amended by substituting thereto the following: Subsection 1, Minimum Area: a For the purpose o f is ordinance, all off-street parking spaces, except where specifically stipulated other- wise herein, shall be paved as provided in Chapter 24 of the City of Tamarac's City Code. (b) An off-street parking space shall be defined as a paved G area not in a public street, alley or right-of-way exclu- sive of driveways, permanently reserved for the temporary storage of one automobile and connected with a public street or alley by a driveway which affords ingress and egress for an automobile without requiring another auto- mobile to be moved. (c) All parking spaces, except in residential districts, shall be at an angle as shown in Exhibit "F", page 2, except that the Planning Commission shall recommend and the City Council may waive this provision and allow (00) or (900) degree angle parking in an amount where and when- ever an unusual circulation hardship would exist by adhering to the strict application hereof and providing that a waiver would not be detrimental to the public safety, health and welfare of the citizens of the City. (d) The width of a parking space where the angle is 600 or less shall be a minimum of nine (91) feet and the stall shall be marked by two painted four inch lines on either side. The length of such a parking space shall be a minimum of 18 feet and provided with wheel stops, as per Exhibit "F" of this ordinance with a minimum of 19 feet backup clearance. A seven W) foot landscaped strip and a continuous concrete curb may be provided instead of wheel stops. (e) The width of a parking space where the angle is (00) or 900 shall be ten (10) feet minimum and the length shall be twenty (20') feet with a minimum of twenty-five (25') foot backup clearance. (f) All parking bays greater than ten cars in length shall have a forward means for egress, all parking bays less than ten cars in length without a forward egress shall have a six (61) foot backup area at the end of the bay. (g) In proposed residential subdivisions served by rights - of -way of less than fifty (50')feet in width, visitor parking spaces shall be provided at a ratio of one space for each five (5) units, conforming to standards included herein and shall be permitted adjacent to such rights -of -way. EXHIBIT "F" SECTION 4: Ordinance 75-35, Section 4, Design Standards, subsection 3, Landscaping, shall be amended by adding thereto the following: Subsection 3, Landscaping: Landscaped areas shall be protected from encroachment by vehicles by wheelstops or continuous concrete curb. SECTION 5: Ordinance 75-35, Section 4, Design Standards, Subsection 5, Entrances and Exits, shall be amended by substitu- ting thereto the following: Subsection 5, Entrances and Exits for Non -Residential Properties: The location and design of entrances and exits to non- residential properties shall be in accordance with the requirements of applicable traffic regulations and standards. The width of a two-lane accessway measured at the property line shall be a minimum of twenty-five (25') feet and a maximum of thirty-two (321) feet. If a third lane is contemplated, a raised curb shall separate the lanes from the alternate direction lane. One lane access widths shall be a minimum of thirteen (13') feet, and a maximum of sixteen (16') feet. Intersections to -- 3 - 1 accessways to abutting development, with streets or other vehicular use areas shall have a minimum 45 foot radius. All driveways intersecting with public streets or alleys shall be elevated at the continuous sidewalk crossing the driveways to eliminate private run-off into public right- of-way. No accessway shall be constructed within eighty (80') feet of a street intersection. Vehicles driven into or out of parking areas shall enter the public right- of-way only by and over authorized driveways or accessways. SECTION 6�: Ordinance 75-35, Section 4, Design Standards, Subsection 6, Markings, shall be amended by substituting thereto the following: Subsection 6, Markings: Parking lots of more than four (4) spaces shall be marked by painted lines or raised concrete curbs or other means to indicate individual spaces. Posted signs and markers shall be used as necessary to insure sufficient traffic operation of the lot. All painted lines, curbs and sign markings shall be maintained in a legible condition. All ingress and egress lanes shall be marked by appropriate painted lines, arrows and stop signs. The arrows shall be painted with plastic silicone paint. SECTION 7: Ordinance 75-35, Section 4, Design Standards, shall be amended by adding thereto a new Subsection 8, Curbing, as follows: Subsection 8, Curbing: Portland Cement Concrete curbing or combination curb and gutter to be installed in parking areas and for their appurtenant improvements (such as accessways and median crossings) installed in street rights - of -way of eighty (801) feet or less shall be in confor- mance with exhibits C, D and E, which are hereby made a part of this ordinance. SECTION 8: Ordinance 75-35, Section 5, Minimum Parking Bay Dimensions by Parking Angle and Parking Bay Illustrations, shall be amended by substituting thereto the following: == (Refer to Figure A, B, C, D and E of Ordinance Parking lot Schematic.) Parking spaces shall be at a minimum of 300 angular parking to a maximum of 600 angular parking. .-� 2. Wheel stops or raised concrete curbs are required for all parking spaces. Refer to figures A, B, C, D and E for details. (Attached exhibits) 3. A minimum backup distance of 20 feet is required between the property line and the first stall as shown in the illustration. 4. All examples show 451 angle parking. 5. A minimum distance of 20 feet is required between the right-of-way line and parallel interior drives. 6. Interpolate for any angles not shown in examples. *Stall must be marked by double lines on each side, other- wise, stall must be 10' minimum width. SECTION 9: Ordinance 75-35, Section 6, Amount of Off -Street Parkin Re uired, Subsection 2V, Restaurant, Cafeteria, Loun e or Other Establishment for the Consumption of Foods and Beverages, shall be amended by substituting thereto the following: Subsection 2V, Restaurant, Cafeteria, Lounge or Other Establishment for the Consumption of Foods and Beverages: "l space per 30 square feet of gross floor area of customer service area shall apply for freestanding detached buildings. In all other cases it shall be calculated as 1 space per 150 square feet of gross floor area." SECTION 1Q: Ordinance 75-35, Section 6, Amount of Off -Street Parking Required, shall be amended by adding thereto a new sub- section known as 2Y, Off-street Parking Requirements in Shopping Centers; Subsection 2Y, Off -Street Parkinq Requirements in Shop2ing Centers: 1. The total number of offstreet parking spaces for a building(s) or use(s) shall not be less than parking requirements for each building or use computed separately. 2. The Director of Community Development shall be required to compile a statistical and graphic record of the total �7= amount of parking spaces provided in each shopping center. The occupational license officer shall receive verification in writing from the Director of Community Development that all contemplated uses have adequate parking spaces provided according to the City of Tamarac's parking ordinance prior to issuing an occupational license. No occupational license shall be issued to a proposed tenant in a shopping center if adequate parking spaces are not provided. SECTION 11: Ordinance 75-35, Section 6, Amount of Off - Street Parking Required, Subsection 4A, Churches, S na o ues or Temples, shall be amended by substituting the following: Subsection 4A, Churches, S na o ues or Tem 1es: "1 space per three seats. Twenty-five (25%) percent of the required parking spaces for a religious purpose may be planted with lawn grass instead of pavement, providing that the area shall be adequately irrigated. The irrigation system shall be protected from damage by parked cars, and designated as overflow parking area (and so marked)". SECTION 12: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 13: Should any section or provision of this Ordi- nance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof other than the part declared to be invalid. SECTION 14: This Ordinance shall become effective immediately upon its final passage, and Section 1, Subsection 6, shall become effective 60 days after final passage. 1977.
