Q- 77 /O AN ORDINANCE LEVYING AND IMPOSING UPON EVERY INSURER, NOW OR HEREAFTER ENGAGING IN THE BUSINESS OF PROPERTY INSURANCE AN EXCISE OR LICENSE TAX IN ADDITION TO ANY LAWFUL EXCISE OR LICENSE TAX NOW LEVIED; PROVIDING FOR COMPUTATION OF TAX; PRO- VIDING TIME WHEN SAID TAX SHALL BE DUE AND PAYABLE; PROVIDING A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Florida created a special fund known as the Municipal Firemen's Pension Trust Fund, and WHEREAS, Chapter 175 authorizes municipalities falling within its purview to levy an additional tax upon certain insurance carriers designated in said Act, and WHEREAS, the proceeds from said tax are to be used in support of said Trust Fund mentioned above, and WHEREAS, the City Council of the City of Tamarac, Florida, is desirous of implementing the provisions of Chapter 175 of the Statutes of the State of Florida, and WHEREAS, the City Council of the City of Tamarac, Florida, has determined that it would be in the best interests of the Muni- cipality to create an Ordinance to this effect. FLORIDA: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, SECTION 1: That there is hereby assessed, imposed and levied on every insurance company, corporation or other insurer now engaged in or carrying on, or who shall engage in or carry on the business or property insurance as shown by the records of the Department of Insurance, an excise of license tax in addition to any lawful license or excise tax now levied by the City of Tamarac, Florida. SECTION 2: That the amount of said excise of license tax referred to in Section 1 shall be two percent (2%) of the gross amount of receipts of premiums from policy holders on all premiums collected on property insurance policies covering property within the corporate limits of the City of Tamarac, Florida. SECTION 3: In the case of multiple peril policies with a single premium for both property and casualty coverages in such policies, seventy percent (70%) of such premium shall be used as the basis for the two percent (2%) tax above. SECTION 4: That said license or excise tax herein levied and assessed shall be due and payable annually on the first day of March of each year hereafter. SECTION 5: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 6: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
