AN ORDINANCE AMENDING CHAPTER 4 OF THE
TAMARAC CITY CODE RELATING TO THE PRESENCE
OF ANIMALS AND FOWL WITHIN THE CITY OF
TAMARAC; PROVIDING FOR CONTROL AND REGULATION
OF ANIMALS IN ORDER TO AFFORD PROTECTION OF
THE PERSONS AND PROPERTY OF THE RESIDENTS OF
THIS CITY: PROVIDING FOR PENALTIES FOR VIOLA-
TION OF THIS ORDINANCE;REPEALING ALL LAWS IN
CONFLICT HEREWITH;PROVIDING A SAVINGS CLAUSE
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That Chapter Four of the Tamarac Code be
amended to read as follows:

ANIMALS AND FOWL
SECTION 4.1: That Ordinances 71-12, 71-25 and 73-68
are hereby repealed.
SECTION 4.2: Definition. The word "animal" as used in
this chapter shall include dogs, cats and other pet and domesticated
animals.
SECTION 4.3: Uncontrolled Animals Generally.
A. No animal shall be allowed upon the public street
of the city or in any public place or upon property other than
that of is owner unless such animal shall be securely under control
or fastened to a suitable leash of dependable strength not to
exceed eight(8) feet in length.
B. Proof of ownership of any such animal found in any
public place or upon property other than that of its owner shall
be prima facie evidence of a violation of this Ordinance.
C. In the event of a violation of this Ordinance, the animal
involved may be picked up by a police officer of the City, public
health officer of the County, the Humane Society of the County,
or any other appropriate and authorized official, and shall be
placed with the Humane Society of the County or any other similar
agency.and retained by such agency for at least five (5) days. As
a condition of repossession of such animal, the owner shall pay to

the Humane Society all costs.
SECTION 4.4.: Animal Bites --Duty to Report --Quarantine.
A. In the event any person is bitten by an animal within
the corporate limits of the City, then it shall become the duty
of such person or the owner of the animal with knowledge thereof
to report such incident to the Police Department of the City, or
to the appropriate County Department, within twenty-four (24)
hours thereafter.
B. Any animal reported to have bitten a person shall be
kept in quarantine for such period of time as may be designated
by the appropriate County,.Department for laboratory analysis by
a licensed veterinarian. No liability for compensation to the
owner of such animal shall attach to the City by virture of any
such procedure by such County Department.
SECTION 4.5: Duty to Remove Excrement, Etc. It shall be
unlawful for any person in control of, causing or permitting
any animal to be on any property, public or private, not owned or
possessed by such person to fail to scoop and remove excrement
left by such animal to a proper receptable located on property
owned or possessed by such person. In accordance with State
Statute, this provision is waived to blind persons assisted by
seeing -eye dogs.
SECTION 4.6.
Penalties. Any person who shall be convicted
of a violation of this Ordinance shall be punished by a fine not
exceeding the sum of Five Hundred Dollars ($500.00) or by imprison-
ment for not more than ninety (90) days, or both such fine and
imprisonment.
SECTION 4.7: Repeal of Conflicting Ordinances. All Ordinances
or parts of Ordinances in conflict herewith are hereby repealed to
the extent of such conflict.
SECTION 4.8
Savings Clause. Should any section or provision
of this Ordinance, or any portion hereof, or any paragraph, sentence
or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole, or any part hereof, other than the

part to be invalid.
SECTION 4.9: Effective Date. This Ordinance shall become
effective immediately upon its final passage.
