HomeMy WebLinkAboutCity of Tamarac Ordinance O-1977-023Proposed by: Temp. # 484 Introduced by: Revised 7/14/77 Revised 7/15/77 CITY OF TAMARAC, FLORIDA ORDINANCE NO. -d AN ORDINANCE AMENDING ORDINANCE NO. 75-39 PROVIDING FOR THE PLACEMENT OF A CONSTRUCTION TRAILER FOLLOWING THE ISSUANCE OF AN ENGINEERING PERMIT; PROVIDING A SAVINGS CLAUSE, REPEALING ALL LAWS IN CONFLICT; PROVIDING AN EFFECTIVE DATE. WHEREAS, it is in the best interest of the Citizens of the City of Tamarac that Contractors be permitted to place construction trailers on sites where active permits have been obtained; and WHEREAS, by allowing such construction trailers it will provide direct supervision on site, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 2, paragraph (C) of Ordinance No. 75-39 is hereby amended to read as follows: "(C) That where a builder holding a valid, active Engineering and/or Building Permit desires to place a mobile vehicle or trailer upon the premises as a temporary construction office, he may apply for a six months' permit for such vehicle, upon payment of a fee of $50.00 (Fifty Dollars) and certification of the safety thereof by the Chief Building Official, and providing that such vehicle is licensed by the State of Florida. Such vehicle shall be kept on wheels and shall be promptly removed upon completion of building operations, or upon any cessation thereof for a period of more than 30 days. The Chief Building Official may enter such orders as he �) i" f deems advisable with respect to the anchoring of the vehicle due to wind or storm conditions, and with respect to sanitary facilities. Any person aggrieved by such order may appeal the same to the Board of Adjustment." SECTION 2: That where a builder demonstrates a need to place a mobile vehicle or trailer upon the premises as a temporary construction office prior to the application and issuance of an active engineering and/or building permit he may apply to the Chief Building Official for a waiver of the pro- visions of this ordinance, requiring as a pre -requisite the approval of a preliminary site plan. In no event shall such permit, if granted, be valid for a period to exceed ninety days and upon payment of a fee of $50.00 (fifty dollars) and certification of the safety thereof by the Chief Building Official and providing that such vehicle is licensed by the State of Florida. At the end of the ninety day period no extension or renewal of this temporary permit may be granted. At the end of this period the mobile vehicle shall either be moved or provisions of Section 1 of this ordinance shall be met. SECTION 3: All ordinances or parts of ordinances and all sections of the Tamarac City Code or parts thereof in conflict herewith be and the same are hereby repealed. SECTION 4: Should any section of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof other than the part declared to be invalid. SECTION 5: This Ordinance shall become -2- effective immediately upon its final passage.
