HomeMy WebLinkAboutCity of Tamarac Ordinance O-1977-027Proposed by:_OLIJ > 7 Introduced by • FYI (,(� Temp. # 1 C CITY OF TAMARAC, FLORIDA ORDINANCE NO. _- _77W7 AN ORDINANCE TO PROVIDE THE RIGHT OF THE CITY OF TAMARAC, TO ACQUIRE, SELL, LEASE, EXCHANGE, FRANCHISE OR DEED PUBLIC PROPERTY, UNDER THE METHODS AND PROCEDURES PROVIDED HEREIN; REPEALING ALL LAWS IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1. Acquire, sell, lease, exchan e etc., property. The City of Tamarac may acquire by purchase, gift, devise, condemnation, or otherwise, property, real or personal or any estate therein, within the City, to be used for public parks, public golf links, public baseball and diamond ball parks, public tennis courts, docks, seawalls, wharves, parking or other municipal purposes; the City shall also have power to extend sewer and drainage pipes and water mains and regulate the use of, operate, maintain, improve, sell, lease, exchange, mortgage, pledge or otherwise dispose of the same or any part thereof for the benefit of the City to the same extent that natural persons might do; that any property, real or personal, required by the City, irrespective of how acquired by the City, may be used, maintained,sold, exchanged or leased, whenever the City Council shall determine that it is in the best interest of the City to do so, provided however: A. That any real property sold by the city except real property being sold to another governmental agency shall be sold upon the following conditions: 1. That a good faith deposit, being a minimum of three-quarters of the city's assessed valuation -on any lot or 79 parcel of land proposed to be purchased, shall be deposited with the city clerk. 2. The terms of such proposed sale and the base bid shall be advertised once a week for at least two weeks in a newspaper of general circulation within the City of Tamarac. 3. That any such lot or parcel shall be sold at public auction at the city hall of the City of Tamarac. 4. That all such sales shall be subject to approval by the city council, and in each case the bid of the highest bidder complying with the terms and conditions set forth in notice of sale shall be accepted, unless the city council shall reject all bids. S. That the city council may provide such other provisions as it may deem necessary, pro- vided such are not inconsistent with the foregoing provision. B. That any real property may be exchanged by the city upon the following conditions: 1. Whenever, in the opinion of the city council, the city holds and possesses any real property, not needed for city purposes, and such property may be to the best interest of the city exchanged for other real property, which the city may desire to acquire for municipal purposes, the said city council is authorized and empowered to make such exchange; provided, however, before any exchange of property shall be effected, a notice, setting forth the terms -2- 09 and conditions of any such exchange of property, shall be first published once a week for at least two weeks in a newspaper of general circulation within the City of Tamarac before adoption by the city council of a resolution authorizing the exchange of properties. C. That any personal property sold, shall be sold only after the terms of the proposed sale have been advertised in a newspaper of general circulation within the City ofTamarac, Florida, once a week for at least two weeks; D. That, prior to the city leasing any real property owned by the city, except leasing to another governmental agency or an entity established under Chapter 163 of the Florida Statutes, being the Florida Tnterlocal Cooperation Act of 1961, public notice shall be given, which notice shall state the terms of such proposed lease, the date, hour and place where the city council shall consider any objections to such proposed lease, and shall also consider any further competitive bids for such real property being leased; E. That, before any personal property owned by or belonging to the city shall be leased by the city, an emergency shall have been declared by the city council whereby the leasing of any such personal property shall be justified and is of benefit to the city; then any such personal property may be leased upon such terms and provisions as may be made by the city council. -3- 86 95 11 1 SECTION 2: This ordinance shall become effective immediately upon its passage.
