HomeMy WebLinkAboutCity of Tamarac Ordinance O-1977-033Temp. #470 Introduced by: PlAwdt44 Revised 5/11/77 Revised 9/2/77 Revised 9/21/77 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0- 77, 33 AN ORDINANCE AMENDING ORDINANCE 77-11; REGULATING THE GAME OF BINGO; PROVIDING FOR THE ISSUANCE OF PERMITS; SETTING A PERMIT FEE; PROVIDING A LIMITATION OF THE NUMBER OF BINGO GAMES PER WEEK CON- DUCTED BY ANY PERMITTED ORGANIZATION; PROVIDING INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WIIEREAS, Ordinance 77-11 provided that except as regulated by the State of Florida by general or special acts of the legislature, Bingo games in the City of Tamarac shall not be regulated except by Ordinances properly adopted by the said City of Tamarac; and WHEREAS, the City of Tamarac wishes to impose a regulatory permit and fee for the conduct of Bingo games held within the City by the various charitable, civic, community, benevolent, religious, scholastic, Fraternal and Veterans organizations together with Condominium Associations or planned Community Associations organized and chartered by the State of Florida as non --profit corporations, and to set a limitation on the number of Bingo games conducted per week by any such organi- zation with a current City permit. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: All charitable, civic, community, benevolent, religious, scholastic, Fraternal and Veterans organizations together with Condominium Associations or planned Community Associations shall comply with the City's zoning laws, Chapter 28 of the Code, 1 applicable to the conduct of Bingo games. SECTION 2: All charitable, civic, community, benevolent. religious, scholastic, Fraternal and Veterans organi- zations together with Condominium Associations or planned Community Associations which desire to perform, conduct, operate, maintain, or supervise a Bingo game must first obtain an annual permit from the City of Tamarac, and shall remit to the -City Clerk an annual___permit fee to the__City in the amount_ of_Twent� Five ($25.00) Dollars to defray administrative and investigative expenses. SECTION 3: A permit may be suspended at any time the Police Chief of the City of Tamarac has reason to believe that: (a) the grounds for issuing the permit no longer exist. (b) the permittee is operating in violation of this Ordinance. (c) the permit was secured by fraud or misrepresentation. (d) Any proceeds derived from such games are shared with anyone other than the permittee and the proceeds from such games are used for any purpose other than the furtherance of legitimate charitable or other lawful purpose. SECTION 4: A limitation is hereby imposed on any charitable, civic, community, benevolent, religious, scholastic, Fraternal and Veterans organizations together with Condominium Associations or planned Community Associations receiving an annual permit, restricting the conduct of Bingo games by a permitted organization to two (2) sessions,day or night, per week. SECTION 5: This Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida; and the Sections of this Ordinance may be renumbered or relettered to accomplish such intention and the word "Ordinance" may be changed to "section", "article", or other appropriate word. SECTION 6: Any person convicted of violating any portion of this Ordinance shall be punished by a definite term of imprisonment in the county jail not exceeding sixty (60) days, and a fine of Five Hundred ($500.00) Dollars as provided by general law. SECTION 7: EFFECTIVE DATE 14.01 The provisions of this Ordinance shall become effective on the 1st day of November , 1977, except that anyone required to have a permit pursuant to this Ordinance shall have obtained such permit by November_1, 1977.
