AN ORDINANCE ADDING AN AMENDMENT TO CHAPTER
151% MOTOR VEHICLES AND TRAFFIC, ARTICLE II,
DIVISION 1. GENERALLY, SECTION 15-4, PRO-
VIDING FOR PARKING RESTRICTIONS IN THE
DEDICATED PUBLIC RIGHT-OF-WAY AREAS AND THE
ENFORCEMENT THEREOF, AND REPEALING SUBSECTION
6 OF SECTION 2 OF ORDINANCE 77-6; REPEALING
ALL ORDINANCES IN CONFLICT; PROVIDING A
SAVINGS CLAUSE: AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Council of the City of Tamarac,
Florida, is desirous of adding an amendment to Section 15-4
of Chapter 15, Motor Vehicles and Traffic, to provide for
parking restrictions in the dedicated public right-of-way
areas and the enforcement thereof, and
WHEREAS, the City Council of the City of Tamarac,
Florida, is desirous of repealing Subsection 6 of Section 2
of Ordinance 77-6.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That Section 15-4 of Chapter IS,
Motor Vehicles and Traffic, shall read as follows:
Sec. IS-4. A. Parking Restrictions - Public
Rights-of-Wav
There shall be no vehicular parking in
the dedicated public right-of-way areas within the
limits of the City during the hours between 2:00 a.m.
and 6:00 a.m., except those vehicles commonly desig-
nated as emergency vehicles. This prohibition shall
apply seven (7) days a week.
B. Enforcement Thereof
1. Enforcement. Any unauthorized person
parking in conflict with Sec. 15-4A is guilty of a
traffic infraction.
2. Ticketing Procedure. Vehicles parked
in violation of this section shall be ticketed by the
Tamarac Police Department, said ticket to be affixed
to the windshield of the offending vehicle. The owner
or operator of said vehicle shall appear at the Tamarac
Police Department within seventy-two (72) hours and
pay a penalty in accordance with the following schedule.
3. Penalty. A charge of $5.00 shall be
assessed for the first violation of this section.
Any repeat violation by the same owner, however, shall
be assessed as follows:
(a) Second violation $10.00
(b) Third violation $15.00
(c) Fourth violation $20.00
(d) Fifth violation and each
violation thereafter $25.00
4. Refusal to accept and sign Citation
or "Notice to Appear". Any person who willfully
refuses to accept and sign a citation or "Notice to
Appear" issued pursuant to this section shall be
guilty of a separate violation and that person may
be arrested by any law enforcement officer of the
City of Tamarac.
S. Failure or refusal to pay penalty. It
shall be unlawful for any person to refuse or fail
to pay any penalty assessed for a violation of this
section and that person shall be guilty of a separate
violation.A penalty of not more than Five Hundred.
($500.00) Dollars shall be assessed. against any person
who shall refuse or fail to pay a. penalty assessed for
violation of this Ordinance.

SECTION 2: Subsection 6 of Section 2 of
Ordinance 77-6 is hereby repealed.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 4: Should any section or provision of
this Ordinance or any portion thereof, or any paragraph, sen-
tence or word be declared by a court of competent jurisdiction
to be invalid, such decision shall not effect the validity of
the remainder hereof as a whole or any part hereof other than
the part declared to be invalid.
SECTION 5: This Ordinance shall become effective
immediately upon its final passage.
