AN ORDINANCE AMENDING ORDINANCE NUMBER 76-44 BY
ADDING SECTION 14 THERETO, PROVIDING FOR WAIVERS
AND EXCEPTIONS TO THE PROVISIONS THEREOF AND RE-
PEALING ALL ORDINANCES IN CONFLICT THEREWITH AND
AN EFFECTIVE DATE.
WHEREAS, it is recognized by the City Council of the
City that due to the diversity of the development of the City,
the rules and regulations provided in Ordinance Number 76-44 do
not and cannot address all situations pertaining to construction
and development within the municipal boundaries of the City.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: Ordinance Number 76-44 of the City of
Tamarac is hereby amended by adding thereto Section 14 as follows:
"Section 14: Provisions for waivers and exceptions
in cases of hardship." The City Council is empowered to grant a
waiver and exception from provisions of this ordinance in cases
of hardship after a preliminary site plan and preliminary plat
have been approved by the Planning Commission.
In the event a person is desirous of seeking a waiver
of, or exception to, the provisions of this ordinance, such person,
or his authorized agent, shall file a petition with the office of
the Director of Community Development and shall simultaneously with
the filing of such petition pay a fee of two hundred fifty ($250)
dollars, which fee shall be used for the purpose of offsetting ad-
ministrative expenses incurred by the City in processing of said
petition, and shall consist of a staff review and written
recommendation to City Council.
Said petition shall be for the construction of five or
fewer living units. Final site plan and final plat shall be
approved by the City Council within six months of date of granting
of waiver or exception. In no case shall said waiver or exception
be for a period of more than one year without the expressed approval
of the City Council.
The petition shall elicit and provide for the
following information:
a) Name, address and telephone number of petitioner.
b) Location of land, together with legal description,
for which waiver or exception is sought.
c) Specific use and location of plan of all structures
and/or parking area as may be required for which waiver or ex-
ception is requested.
d) The nature of the hardship and such other information
as petitioner deems necessary to apprise the City Council of the
relevant facts and circumstances.
Upon receipt of the petition and the payment of the re-
quired fee, the City Council shall consider the petition as an
agenda item at a meeting of the City Council to be held within
thirty (30) days of filing of the petition. At this time, a cash
bond amount shall also be set pursuant to the particular waiver or
exception requested by the petitioner.
In the event the waiver or exception is granted by the
City Council, said City Council shall cause a resolution to be
issued stating the terms and conditions, including all appropriate
fees upon which the waiver or exception has been granted, along
with the cash bond amount, and shall cause a copy of said resolution
to be made a part of the municipal records of the City."
SECTION 2: Should any section or provision of this
ordinance or any portion thereof, or any paragraph, word or sen-
tence be declared by a court of competent jurisdiction to be
invalid, such decision shall not effect the validity of the remainder
hereof as a whole or any part hereof, other than the part declared
to be invalid.
SECTION 3:
All ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
SECTION 4: This ordinance shall become effective
immediately upon its final passage.
