ORDINANCE NO. 0-1`1-39
AN ORDINANCE AMENDING CHAPTER 28, ZONING,
ARTICLE XI, RO RESIDENTIAL OFFICE DISTRICT,
SECTION 28-105 (c), SETBACK REQUIREMENTS,
AND ARTICLE XII, RO-A LIMITED RESIDENTIAL
OFFICE DISTRICT, SECTION 113 (c), SETBACK.,
REQUIREMENTS; PROVIDING A SAVINGS CLAUSE;
REPEALING ALL LAWS IN CONFLICT HEREWITH:
AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
SECTION 1: Section 28-105(c), Article XI
of Chapter 28, Zoning, shall be amended to read as follows:
Sec. 28-105. Setback requirements.
(c) No parking shall be permitted
within any required street setback, and where
an R-0 district abuts any residentially zoned
district, no parking shall be permitted within
the required lot line setback area adjacent to
the residentially zoned property, except where
the abutting property is an R-0 or RO-A district
parking may be permitted in the setback area
adjacent to such a district.
SECTION 2: Section 113(c), Article XII of
Chapter 28, Zoning, shall be amended to read as follows:
Sec. 28.113. Setback requirements.
(c) No parking shall be permitted
within any required street setback, and where
an R-OAdistrict abuts any residentially zoned
district, no parking shall be permitted within
the required lot line setback area adjacent to
the residentially zoned property, except where
the abutting property is an R-0 or RO-A district
parking may be permitted in the setback area
adjacent to such a district.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of
this Ordinance or any portion thereof, or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder hereof
other than the part declared to be invalid.
SECTION S: This Ordinance shall become
effective immediately upon its final passage.
