ORDINANCE NO. D' %?-
AN ORDINANCE AMENDING CHAPTER 7, ARTICLE II,
DIVISION I SITE PLAN AS AMENDED BY ORDINANCE
76-44, OF THE CITY OF TAMARAC BY AMENDING
SECTION 6A, PARAGRAPH 4; AND ADDING TWO NEW
PARAGRAPHS REPEALING 6B; AND SUBSTITUTING
THEREFORE A NEW SECTION 6B; REPEALING SECTION
7A AND SUBSTITUTING THEREFORE A NEW SECTION 7A;
PROVIDING A SAVINGS CLAUSE: REPEALING ALL LAWS
IN CONFLICT THEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SFrTTnN l: That Ordinance #76-44 is hereby amended and
shall read as follows:
SECTION 2: Section 6A. Final Site Development Plan
Requirements, Paragraph Four shall be amended and shall read as
follows:
"4. Ten (10) copies of landscape plans containing the
information required in Section 6B"
SECTION 3: Section 6A, Final Site Development Plan
Requirements shall be amended by adding Paragraph Eleven and Para-
graph Twelve and shall read as follows:
"11. Off -Site Easements in recordable form approved
as to form by the City Attorney and approved as to
content by the City Engineer."

or engineer."
SECTION 4: Section 6B, Landscape Plans, shall be amended
and shall read as follows:
"B. Landscape Plans. Landscape Plans shall be submitted

on a separate drawing with the final site development
plan for review by the Planning Commission, accompanied
with a City of Tamarac Landscape Check List completed
by the petitioner.
The following information is required to be included on all landscape
plans (in scale) no less than V = 30',on 24" x 361' sheets.
1. Ten (10) copies of landscape plans sealed either by a
registered architect or landscape architect or nursery
man approved by the Chief Building Official.
2. Project Title.
3. Developer.
4. North arrow and scale.
5. All boundary dimensions.
6. All existing vegetations.
7. Preserved trees and relocated trees.
8. Certification that an irrigation system (free of rust)
will be provided for landscaped area.
9. Common names as well as botanical names of proposed
plant material with minimum trunk diameter and height
at time of planting. Include type of ground cover.
10, Location and size of material to be used.
11. Design, location and material of any walls and fences.
Include car stops and curbing.
12. Location of proposed ground signs, if any.
13. Location of dumpsters, if any.
14. Elevations of structures showing concealment of roofscapes.
All developments shall incorporate native vegetation into
landscape plans. Undesirable species, such as Australian Pine, (Cesurina),
Brazilian Pepper (Florida Holly), Castor Bean, and Melaleuca, shall
be prohibited. Where a commercially zoned district abuts a residential
district, refer to the Ordinances on setbacks, fences, trash containers
or dumpsters for additional requirements.
SECTION 5: Section 7, City Council Review of Final Site

Development Plan shall be amended and shall read as follows
A. The Secretary of the Planning Commission shall be re-
sponsible for transmitting the documents outlined below to the City
Council for reviews. In no case shall the petition be agendized for
Council consideration until all necessary documents have been sub-
mitted in acceptable form.
1. Report by the City Engineer indicating approval of
the engineering drawings.
2. Report by the City Planner indicating approval.
3. Report by the Chief Building Official indicating approval.
4. Off -site easements in recordable form approved as to
form by the City Attorney, and approved as to content
by the City Engineer.
5. Covenants and Certificate of Title, if any, approved
by the City Attorney.
6. Recommendation from the Planning Commission.
7. Approval, in writing, from Tamarac Utilities indicating
the acceptance of the final engineering drawings, if
applicable.
8. Itemized check list of all required processing fees.
9. Itemized on -site and off -site improvement bond and fee
schedule prepared by the applicant and approved by the
City Engineer. The Petitioner shall be required to
submit a certified list consisting of all materials
(unit cost and total cost) for items included in, but
not limited to Section 3, Definitions of Public and
Private Improvements and Section 24-3, Paragraph (a) of
Tamarac's City Code, as amended, to the City Engineer,
in order to properly prepare the necessary schedule.
10. Final Plat (if applicable).
B. Site Development Plan Approval by the City Council.
The City Council shall review the final site development
plans at a public meeting. No final site development

plan or plat shall become effective until receiving
approval by the City Council.
Should the Citv Council approve the final site
development plan, the Mayor shall stamp the reproducible
original of the final site development plan and shall
transmit the plan to the master file for storage.
The City Council shall as a condition of approval
of the final site development plan and/or plat require
the payment of all required fees and submission of
all required bonds prior to the issuance of public
improvement and/or building permits. The City Clerk
Shall be responsible that all required recordable
documents are recorded in Broward County.
SECTION 6: Should any section or provision of this
Ordinance or any portion hereof, or any paragraph, sentence or word
be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof other than the part declared to be invalid.
SECTION 7: All ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed, as of the
effective date of this ordinance.
SECTION $: This ordinance shall become effective immediately
upon its final passage.
