O- -7d0—ZZ AN ORDINANCE AMENDING ORDINANCE #75-5 OF THE ORDINANCES OF THE CITY OF TAMARAC, FLORIDA, BY REVISING SECTION 2: DEFINITIONS. (a) "GENERAL FLOOD HAZARD DISTRICT" and SECTION 3: DEVELOPMENT IN GFH DISTRICTS (d); BY ADDING TO SECTION 3 DEVELOPMENT IN GFH DISTRICTS NEW SUBSECTIONS (f) (g) (h) (i)&(j) TO COMPLY WITH THE FLOOD PLAIN MANAGEMENT REGULATIONS, SECTION 1910.3 (c) OF THE FEDERAL REGULATIONS PROMULGATED BY THE FEDERAL INSURANCE ADMINISTRATOR. REPEALING ALL LAWS IN CONFLICT AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Tamarac, Florida: SECTION 1. That Ordinance 75-5, Sec. 2: DEFINITIONS (a) is here- by amended to read as follows: "SECTION 2: DEFINITIONS. For the purpose of this chapter, the following definitions shall apply: (a) General Flood Hazard District (hereinafter referred to as GFH DISTRICT) means that portion of the City of Tamarac com- prised of those areas designated upon the Official Flood Insurance Rate Map issued and approved by the Federal Insurance Administra- tion, dated February 15, 1978 and numbered Community Panel Number 120058 0001 B; 120058 0002 B; 120058 0003 B; and as the same may from time to time, be amended by the Federal Insurance Admin- istrator." SECTION 2. That Ordinance 75-5, Sec. 3: Develo ment in GFH District (d) is hereby amended to read as follows: "SECTION 3. Development in GFH Districts -- Building Permit Requirements. (d) Regulatory Flood (also herein referred to as 100 year flood) means the level of flooding that, on the average, is likely to be equaled or exceeded once in any 100 year period (i.e., that has a one percent chance of occurring in any year). For purposes of this chapter the regulatory shall be that elevation as estab- lished by the Federal Insurance Administration, 100 year flood standard as published on the Flood Insurance Rate Map (FIRM) for the City of Tamarac, together with revisions thereto, which may be made from time to time." SECTION 3: That Ordinance 75-5 is hereby amended by adding to Sec. 3 Development in GFH Districts, new subsections "f", "g", "h"� "i" and IT" to comply with the Flood Plain Management Regulations, Section 1910.3 (c) of the Federal Regulations promulgated by the Federal Insurance Administrator, which shall read as follows: "Section 3. DEVELOPMENT IN GFH DISTRICTS - Building Permit Requirements. (f) Review permits for proposed development to assure that all other necessary permits have been received from those governmental agencies from which approval is required by Federal or State law. (g) Require that all. subdivision proposals and other proposed new development greater than 50 lots or 5 acres, which- ever is less, include base flood elevation data. (h) When flood proofing is utilized for a particular structure, the Chief Building Official shall obtain certification from a registered professional engineer or architect that the plans comply with Section 2(c) of Ordinance 75-5. (i) Obtain and maintain records of elevations and flood proofing levels for all new or substantially improved struc- tures and whether or not such structures contain a basement. (j) In riverine situations, notify adjacent communities -2- 1 and the State coordinating office prior to any alteration or relocation of a watercourse and submit copies of such noti- fications to F.I.A. Within the altered or relocated portions of any watercourse, assure that the flood carrying capacity is maintained." (j) Mobile homes affixed to a lot, with or without a foundation, shall be anchored to resist .flotation, collapse, or laterial movement by providing over the top and frame ties to ground anchors to withstand winds in excess of ninety (90) miles per hour. It does not include recreational vehicles or travel trailers. SECTION 4. All Ordinances or parts of Ordinances in conflict herewith, are hereby repealed to the extent of such conflit. SECTION 5. This Ordinance shall become effective immediately upon its final passage. PASSED FIRST READING this / . _day of 4,1978.
