D- 7 (P—/cP AN ORDINANCE RECLASSIFYING THE RESIDENTIAL OFFICE DISTRICT (R-0) AS AMENDED T B-6 BU INESS DISTRICT; RECLASSIFYING THE LIMITED RESIDENTIAL OFFICE DISTRICT (R-OA) AS AMENDED TO B-5 BUSINESS D STRICT PROVIDING FOR THE RECLASSIFICATION OF CERTAIN ARTICLES IN TAMARAC'S ZONING CODE; PROVIDING FOR A NEW B-5 BUSINESS DISTRICT LIMITED; PROVIDING FOR A NEW B-6 BUSINESS DISTRICT; PROVIDING A SAVINGS CLAUSE; REPEALING ALL LAWS IN CONFLICT; PROVIDING AN EFFECTIVE DATE. WHEREAS, Article XI, Residential Office District, (R-0), the tame being Ordinance No. 73-63 and Article XII, Limited Residential Office District, (R-OA), the same being Ordinance No. 74-14, as both are amended by Ordinance No. 0-77-39 are present Zoning Districts in the City of Tamarac, Florida, and WHEREAS, these Zoning Districts are generally designated as commercial areas on the Broward County Land Use Plan, and WHEREAS, pursuant to the adoption of Ordinance No. 77-66 by Broward County related to the area of land use planning and implementation, Tamarac's list of permitted uses in the R-0 and R-OA Zoning Districts do not comply with the primary list of permitted uses in commercial areas outlined in the "Broward County Land Use Plan 1977", and WHEREAS, it is the desire of the City Council of Tamarac to conform with the permitted uses of Broward County's commercial land use designation, and WHEREAS, it is necessary to remove free standing residential dwelling units from the primary list of permitted uses in the R-0 and R-OA Zoning Districts as well as all referenr—es to. residential as a___primary use in the districts' regulations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TAMARAC, FLORIDA: SECTION 1: That Chapter 28, Article XII, Limited Residential Office District, (R-OA), the same being Ordinance No. 74-14 as amended by Ordinance No. 77-39 is hereby repealed and all lands in the City presently zoned R-OA, as shown on the map attached hereto, shall be reclassified to the B-5 Zoning District as set forth in Section 5 of this Ordinance. SECTION 2: That Chapter 28, Article XI, Residential Office District, (R-0), the same being Ordinance No. 73-63 as amended by Ordinance 77-39 is hereby repealed and all lands in the City presently zon�d.,R-0, as shown on the map attached hereto, shall be reclassified to the B-6 Zoning District as set forth in Section 6 of this Ordinance. SECTION 3: That Chapter 28, Article XVIII, B-3 General Business District shall be reclassified to Article XVIIA. SECTION 4: That Chapter 28, Article XVIIA, Business and Commercial Uses Generally shall be reclassified to Article XVIIB, SECTION 5: A new Article XVIIC shall be added to Chapter 28 of the City of Tamarac"s Zoning Code as follows: Section 28.171.001: Article XVIIC, B-5 Business District - Limited. The following regulations shall apply in all B-5 Zoning Districts: Section 28.171.002: Purpose of the District: The purpose of the B-5 Zoning District is to encourage the development of an inte- grated mix of limited professional and business developments with accessory residential dwelling units on the second floor of the primary structure along and adjacent to major arterial roadways and providing services to a consumer market of several neighborhoods. Section 28.171.003: Uses Permitted: No building or structure, or part thereof, shall be erected, altered or used, or land or water used, in whole or in part,for other than: 1. The business uses permitted shall be those designated for B-1 Zone in the City's Master List of business uses except that the retail or wholesale storage or sale of any item or product is prohibited other than those allowed as an accessory use permitted by Section 28.171.004. Where special exceptions are noted, Council action shall be required. 2. Residential dwelling with a minimum of 750 square feet per unit may be permitted on the second floor of the structure provided the residential floor area does not exceed 50% of the total floor area of the building. - 2 - Section 28.171.004: Accessory Uses Permitted. An office building may include certain accessory uses such as a coffee shop, newsstand, barber shop, beauty shop, or employees' lounge; provided however, the building shall contain a gross floor area of at least fifteen thousand (15,000) square feet of commercial floor area, all accessory uses are oriented primarily to the employees within, no external features shall be permitted to advertise such accessory uses, and not more than twenty (20) percent of the gross floor area of the building(s) shall be devoted to accessory uses. Section 28.171.005: Size of Plot. Every plot shall be not less than k acre in area, and shall have not less than 100 feet minimum frontage. Section 28.171.006: Height. No building or structure, or part thereof, shall be erected, or altered to a height exceeding 2 stories or 30 feet excluding elevator penthouses and stairtowers. However, maximum height shall not exceed forty (40) feet. Section 28.171.007: Plot Coverage. The combined area occupied by all structures shall not exceed 35 percent. Section 28.171.008: Setback Requirement. 1. Street yard = 25' General (Street setbacks along University Drive shall be 125' from center line of roadway). Driveways are permitted in street setbacks. 2. Interior lot line (side or rear): 20 feet. 3. No parking shall be permitted within any required street setback, and where a B-5 District abuts residentially zoned district, no parking shall be permitted within the required lot line setback area adjacent to the residentially zones property. SECTION 6: A new Article XVIID shall be added to Chapter 28 of the City of Tamarac's Zoning Code as follows: Section 28.171.051: Article XVIID, B-6 Business District: The following regulations shall apply in all B-6 Zoning Districts. Section 28.171.052: Purpose of the District: The purpose of the B-6 Zoning District is to encourage the development of an integrated mix of professional and business developments with accessory. residential dwelling units in the primary structure along major arterial roadways serving a regional consumer market. - 3 - Section 28.171.053: Uses Permitted: No building or struc- ture,or part thereof, shall be erected, altered or used, or land or water used, in whole or in part, for other than: 1. The business uses permitted shall be those designated for B-1 Zone in the City's Master List of business uses except that the retail or wholesale storage or sale of any item or product is prohibited other than those allowed as an accessory use permitted by Section 28.171.054. Where special exceptions are noted, Council action shall be required. 2. Residential dwelling with a minimum of 750 square feet per unit may be permitted on the upper floors of the structure provided the residential floor area does not exceed 50% of the total floor area of the building. Section 28.171.054: Accessory Use Permitted. An office building may include certain accessory uses such as a coffee shop, newsstand, barber shop, beauty shop, or employees' lounge; provided, however, the building shall contain a gross floor area of at least fifteen thousand (15,000) square feet of commercial floor area, all accessory uses are oriented primarily to the employees within, no external features shall be permitted to advertise such accessory uses, and not more than twenty (20) percent of the gross floor area of the building(s) shall be devoted to accessory uses. Section 28.171.055: Size of Plot. Every plot shall be not less than 100 feet minimum frontage. Section 28.171.056: He fight. No building or structure, or part thereof, shall be erected or altered to a height exceeding three (3) stories or forty (40) feet; provided however, elevator and mechanical equipment enclosures and stair towers may exceed the height of the building by twelve (12) feet. Section 28.171.057: Plot Coverage. The combined area occupied by all structures shall not exceed the percent given in the following table for various heights of the building: - 4 - 1 1 Height Percent 1 Story 40 2 Stories 35 3 Stories 30 Section 28.171.058: Setback Requirements. 1. SECTION 7: Should any section or provision of this Ordinance or any portion hereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 8: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 9: This Ordinance shall become effective immediately upon its final passage. PASSED FIRST READING this day of 1978. PASSED SECOND READING this day of 1978.
