CITY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF TAMARAC, REPEALING
SECTIONS 6-26 and 6-27 OF ART. III OF CHAPTER 6 AND
AMENDING CHAPTER 7, BY ADDING THERETO DIVISION 3,
SECTION 7-30, DUMPSTERS, RELATING TO THE STANDARDS
FOR THE LOCATION AND CONSTRUCTION OF TRASH ENCLOSURES;
AND AMENDING CHAPTER VII BY ADDING THERETO DIVISION 4,
SECTION 7-31, ROOFSCAPES, ESTABLISHING STANDARDS FOR
CONCEALING MECHANICAL EQUIPMENT ON ROOF TOPS IN ALL
ZONING DISTRICTS: PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: Chapter 6, Beautification, Article III, Section
6-26 and 6-27 of the Code of the City of Tamarac, are hereby
repealed.
SECTION 2: Chapter 7, Building, is hereby amended by adding
thereto a new Division 3, Section 7-30, of the Code of the
City of Tamarac, to read as follows:
SECTION 7-30: DUMPSTER REQUIREMENTS
(1) All bulk containers required by the Broward County
Code of Ordinances relating to the collection and
disposal of garbage shall be designed, constructed,
and maintained in conformance with the following
standards and criteria.
(2) The Petitioner's responsibility to demonstrate
compliance with the aforesaid shall be required
prior to receiving approval of either a preliminary
site development plan, requesting a final building
inspection, certificate of occupancy.
(3) The owner and/or tenant shall submit to the Chief
Building Official proof of a contract for collection
of trash and garbage with a collector franchised in
the City prior to requesting any certificate of
occupancy or occupational license in a format avail-
able in the Office of the City Clerk.
(4) Construction and Location Standards: All exterior
trash enclosures in new developments or requested
revisions in existing developments, or upon request
for a new or renewed occupational license involving
the retail or wholesale consumption, manufacturing,
sale or storage of food or food products shall be
required to comply with the following standards:
(a) It is the responsibility of the proposed user to
identify the number, size and material of all trash containers and
enclosures, either known or generally estimated, on the Preliminary
Site Development Plans submitted to Tamarac for development or
building permits.
(b) All trash receptacles shall be required to be
shielded by solid masonry walls (stuccoed and painted) and solid
gates.
(c) The height of the walls and gates shall be as
follows:
Up to 6 cu yd. container ---- 6' high
Up to 8 cu yd. container ---- 8' high
(d) The minimum inside dimensions of the enclosure
shall be three (3) feet wider than the width of the receptacle and
two (2) feat deeper than the depth. If the size of the receptacle
is unknown, then the minimum size of a proposed enclosure shall be
no less than 10' by 10' (inside dimensions) with 6' high walls.
(e) The gates of the enclosure shall have no panel
wider than 6' and be constructed of a material of sufficient
strength to withstand normal daily use of rubbish disposal and
pickup. Chain link gates with slats are not permitted. Solid
metal posts shall be placed in front of the gate hinges. However,
hinges may be attached to the posts.
(f) The base of the enclosure is to be concrete with
a minimum of 4" in depth.
(g) SETBACKS: The enclosures shall be permitted to
encroach into the side and rear setbacks up to three (3) feet
from the property line when the abutting property is zoned B-1,
B-2, B-3 or M-1. When the enclosure is placed adjacent to property
lines abutting all other districts, the setbacks shall be the same
dimensions as for the principal buildings.
(h) All dumpsters located within a building shall be
in trash rooms provided with an automatic sprinkler, washing
facilities and deodorizing system.

(i) The trash receptacles and enclosure shall be
located in a position convenient to pickup by front-end
and back -end loaders.
SECTION 3: Chapter 7,' Building, is hereby amended by
adding thereto a new Division 4, Section 7-31 of the Code of
the City of Tamarac to read as follows:
SECTION 7-31 -- ROOFSCAPES
The height of exterior perimeter walls of all buildings
in all zoning districts except R-1, R-1B, R-IC and R-2 shall
be higher than the total height of all accessory equipment
installed on the roof of the proposed building.
All air conditioning units, condensers, and/or electrical fans
attendant thereto shall be prohibited from being installed
on all residential and accessory roof areas in R-1, R-IB,
R-1C and R-2 zoning districts, unless the same shall meet
the following requirements:
1. The proposed air conditioning unit shall
be placed on a structural element meeting the
requirements of the South Florida Building Code,
Broward Edition.
2. The proposed plans accompanied by fee,
shall be submitted to and approved by the Tamarac
Building Department.
3. Permanent, obscure screen shall be placed
along all sides of the unit which is viewed by the
public, the minimum height of which shall be one
foot above the top of the unit.
SECTION 4: Severability Clause: Should any section
or provision of this Ordinance or any portion hereof, or any
paragraph, sentence, or word be declared by a court of com-
petent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or
any part hereof, other than the part to be declared invalid.

SECTION 5: Conflict: All Ordinances or parts of
Ordinances in conflict herewith be and the same are hereby
repealed, as of the effective date of this Ordinance.
SECTION 6: Effective Date: This Ordinance shall take
effect immediately upon its final passage.
