O - %P _,� 0 AN ORDINANCE AMENDING CHAPTER 24 of the TAMARAC CITY CODE, AS AMENDED BY ORDINANCES No. 76-40 and 76-89, ARTICLE II, PAVEMENT, SEC. 24-14.4; DECLARING AN EMERGENCY; PROVIDING A SAVINGS CLAUSE; REPEALING ALL LAWS IN CONFLICT AND PRO- VIDING AN EFFECTIVE DATE. WHEREAS, the City Council has received a recommendation from the City Engineer for the amendment of Chapter 24, of the Tamarac City Code, as amended by Ordinances No. 76-40 and 76-89, Article II, Pavement, Sec. 24-14.4; and WHEREAS, the City Engineer has requested that City Council enact the amendment as an emergency; and WHEREAS, City Council has determined that the enactment of an amendment as an emergency is appropriate, in order to assure safe vehicular ingress and egress to driveways between private property and a public street, which will in turn promote the health, safety and general welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Sec. 24-14.4, Private Accessways, of Chapter 24 of the Tamarac City Code as amended by Ordinances No. 76-40 and 76-89, is hereby amended to read as follows: 'S'ec. 24--14.4. PRIVATE ACCESSWAYS (a) Performance bonds and engineering inspection fees for accessways which have not been included as part of previously approved site development plans shall be in accordance with Chapter 23 of this Code. (b) All vehicular ingress and egress driveways between private property and a public street shall meet the design requirements of the City Engineer and shall be covered by a driveway permit issued by the City Engineer. Each drive will be reviewed according to the conditions existing at each location or according to known future conditions as determined by the City Engineer. 1 Minimum general design requirements are: (1) No drive shall be located closer than 25-feet to the right-of-way of a street intersection. At signalized intersections, the City Engineer will specify distances from right-of-way or pavement edge to allow for suf- ficient stacking of vehicles in the street prior to the driveway location. (2) Double drives shall be separated by a minimum of 20-feet or as required so that the driveway return radii do not overlap. (3) Driveway widths: Two --way One-way 24-feet minimum 12-feet minimum (4) Driveway return radius: Residential 5 feet minimum Business, Institu- tional 10-feet minimum (5) Driveway Setback for Vehicular Storage 36-feet maximum 16-feet maximum 15-feet maximum 45-feet maximum For shopping centers, businesses, institutions or other uses that require parking lots with over fifty spaces, the minimum storage to be provided between the edge of public street pavement to edge of the first internal drive shall be 50-feet. In lots with over 100 spaces, the storage shall be 90-feet. This storage shall be provided by in- stalling a curb on both sides of the driveway for the full distance. SECTION 2: The City Council does hereby declare that the enactment of this Ordinance as an emergency measure is necessary and vital to promote the health, safety and general welfare of the public. SECTION '3: Should any section or provision of this Ordi- nance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared ERM 1 1 L7 to be invalid. SECTION 4: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 5: This ordinance shall become effective immediately upon its passage at First and Second Reading. PASSED FIRST READING THIS DAY OF 1978.
