GENERALLY, SECPTCN 1 -T, PROVIDINCr FOR PARKING RESTRICTICNS IN THE DFDICATFD PUBLIC RIGHT -OF WAY AREAS AND THE FNFORCIIViENT THEREOF, AND REPEALING SUBSECrICN 6 OF SECTION 2 OF ORDINANCE 77-6; REPEALING ALL ORDINANCES IN CCJNFLICT; PROVIDING A SAVINGS CLAUSE: AND PROVIDING AN EFFFCTTVE DATE WHEREAS, the City Council of the City of Tamarac, Florida, is desirous of amending Section 1 of Ordinance 77--36, City Code Chapter 15, Motor Vehicles and Traffic, which provides for parking restrictions in the dedicated public right -of --way areas and the enforcement thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY ODUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Section I of Ordinance 77-36, Section 15-4 of Chapter 16 of the City Diode, Motor Vehicles and Traffic, shall read as follows: Sec. 15--4. A: Parking Restrictions - Public Ri ts-bf:WaX There shall be no vehicular parking in the paved portions of the dedicated public right-of-way areas within the limits of the City during the hours between 2:00 a.m. and 6:00 a.m., except those vehicles commnly designated as emergency vehicles. This prohibition shall apply seven (7) days a week. B. Enforcement Thereof 1. Enforcement. Any unauthorized person parking in conflict with Sec. 15-4A is guilty of a traffic in -fraction. 2. Ticketing Procedure. Vehicles parked in violation of this section shall be ticketed by the Tamarac Police Department, said ticket to be affixed to the windshield of the offending vehicle. The owner or operator of said vehicle shall appear at the Tamarac Police Department within seventy-two (72) hours and pay a penalty in accordance with the following schedule. Or 7P-z3 3: Penalty. A charge of $5.00 shall be assessed for the first violation of this section. Any repeat violation by the same owner, however, shall be assessed as follows: (a) Second violation $10.00 (b) Third violation $15.00 (c) Fourth violation $20.00 (d) Fifth violation and each violation thereafter $25.00 4. Refusal to accept and sign Citation ®r "Notice to Appear". Any person who willfully refuses to accept and sign a citation or "Notice to Appear" issued pursuant to this section shall be guilty of a separate violation and that person may be arrested by any law enforcement officer of the City of Tamarac. 5. Failure or'refusal to Pay penalt . It shall be unlawful for any person to refuse or fail to pay any penalty assessed for a violation of this section and that person shall be guilty of a separate violation. A fine of not more than Five Hundred ($500.00) Dollars shall be assessed against any person who shall refuse or fail to pay a penalty assessed for violation of this Ordinance. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby bepealed to the extent of such conflict. SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not effect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. -2- D- 78-2-3 1 LJ 1 This Ordinance shall become effective immediately upon its final passage.
