HomeMy WebLinkAboutCity of Tamarac Ordinance O-1978-036Introduced by: Petition #4-Z-78 Temp. #534 Rev. 5/25/78 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 -)9 30 31 32 33 34 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0 - 78-36 AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY DESCRIBED AS PARCEL A OF THE MAINLANDS OF TAMARAC LAKES, UNIT 15, AS RECORDED IN PLAT BOOK 71, PAGE 3, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LESS THE WEST 100 FEET OF THE NORTH 690.10 FEET OF PARCEL A. (OTHERWISE IDENTIFIED AS THOSE UNDEVELOPED LANDS IN VANGUARD VILLAGE EXCEPTING THAT STRIP PF LAND MEASURING 100 FEET BY 690.10 FEET AS REFERRED TO ABOVE) FROM R-4A TO R-1B, PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida public notice has been given in accordance with the applicable Law of the time and place of public hearing regarding the zoning of the property described herein, and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been, heard; and the Council has examined and investigated the request for the zoning herein and has received the recommendation of the Planning Commission of the City of Tamarac, and WHEREAS., public hearing has been held on Petition #4-Z-78 by the City Council pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby rezoned from R-4A classification to R-1B classification. SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect this change in zoning, said changes to beinitialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. SECTION 3: All ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict. The Provision in Section 28-25 of the City Code, which provides that zoning applications not acted upon within ten days of the public Temp. #534 Rev. 5/25/78 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 hearing thereon or within forty days of the public hearing if the Council, by its own motion, extends the time for an additional thirty days shall be deemed a denial if the application is found to be in conflict with this Ordinance and shall be deemed repealed for the purposes of this Ordinance. SECTION 4: Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: This ordinance shall become effective immediately upon its final passage. PASSED FIRST READING THIS 24 DAY OF April 1978. PASSED SECOND READING THIS 14 DAY OF June 1978.
