AN ORDINANCE CREATING AN RD-7 TWO FAMILY RESIDENTIAL ZONING DISTRICT; SETTING FORTH PERMITTED USES WITHIN AN RD--7 DISTRICT; ESTABLISHING MINIMUM LOT SIZE, LOT COVERAGE, HEIGHT, STREET, SIDE AND REAR SETBACKS; ESTABLISHING MINIMUM FLOOR AREA; ALLOWING SEPARATE OWNERSHIP OF DUPLEX BUILDINGS; AMENDING SECTION 28-2 OF THE CITY CODE WHICH ESTABLISHES AND ENUMERATES THE VARIOUS ZONING DISTRICTS IN THE CITY BY ADDING THE RD-7 TWO FAMILY RESIDENTIAL DISTRICT; PROVIDING RE- PEALER; PROVIDING FOR SEVERABILITY OF INVALID PRO- VISIONS; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of Tamarac has determined the need to create an RD-7 two family residential dwelling zoning district which would allow for separate ownership of each unit of a two family dwelling; and WHEREAS, the Planning Commission has considered and approved this concept. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TAMARAC, FLORIDA: SECTION 1: There is hereby created in the City of Tamarac a new RD-7 duplex residential zoning district. The require- ments for said district are set forth below. The regulations con- tained in this ordinance shall apply in all RD-7 districts. SECTION 2: No building or structure, or part thereof, shall be erected, altered or used, or land or water used, in whole or in part, for other than the following specified uses: A. Uses permitted in R­l B and R- l C Single Family P.es i denti al Zoning Districts subject to the limitations, requirements and procedures specified for that Zoning District. B. Duplex Dwellings (Two Single Family Attached Residential Dwelling Units). At least one habitable room or garage in each unit shall adjoin for a distance not less than ten (10') feet in length. Private outdoor areas shall be provided for each unit visually screened from the adjoining dwelling unit. C. Municipally owned or operated facilities of any nature whatsoever not in conflict with the Broward County Land Use SECTION 3: Lot Size A. Duplex Dwellings. Every lot upon which duplex res- idential dwel-l-ings-are erected shall be not less than one hundred (100') feet in width and ten thousand (10,000) square feet in area. B. Nonresidential uses. Every lot upon which a permitted nonresidential structure or use is erected or placed shall be not less than two hundred feet in width and forty thousand (40,000) square feet in area SECTION 4: Lot Coverage. The combined area occupied by all buildings shall not exceed forty (40%) percent of the area of i the lot. SECTION 5: Hei ht of buildings -or structures. No building or structure, or part thereof, shall be erected or altered to a height exceeding either two stories or thirty (30') feet; except that a steeple on a church may extend to a height of fifty (50') feet, SECTION 6: Street Yard Setbacks. A. Residential Uses. Every lot used for single story dwelling purposes shall have a street yard not less than twenty-five (25) feet in depth.._ - -- -- - - - - - - Every lot used for two story dwelling purposes shall have a street yard not less than twenty-five (25') feet in depth. B. Nonresidential uses. Every lot whose principal use is nonresidential shall have a front yard not less than thirty (30') feet in depth. A. Residential Uses. Every lot used for one story dwelling purposes shall have a side yard on each side not less than seven and one-half (721) feet in depth. Every corner lot shall have a side yard at least fifteen (15') feet in width on the side of the lot abutting on the' side street. B. Nonresidential Uses. Every lot whose principal use is nonresidential shall have a side yard on each side, each of which shall be not less than twenty (20') feet in width, with an increase of one foot in width of each side yard for each two feet in height of the structure in excess of twenty (20') feet. SECTION 8: Rear Yard Setbacks A. Residental Uses. Every lot used for one story dwelling purposes shall have a rear yard not less than fifteen (15') feet in depth. Every lot used for two story dwelling purposes shall have a rear yard not less than twenty (20') feet in depth. In cases where a rear lot line abuts a waterway without a bulkhead, the rear yard shall not be less than twenty-one (21') feet in depth. B. Nonresidential Uses. Every lot whose principal use is nonresidential shall have a rear yard not less than twenty-five (25') feet in depth. SECTION 9: Floor Area. The minimum floor area of each individual duplex unit shall be 860 square feet. The minimum floor area of a one -family dwelling unit shall be one thousand (1,000) square feet. SECTION 10: Each unit of a duplex building within this district may have separate ownership. SECTION 11: Section 28-2 of the Tamarac City Code is amended to read as follows by adding an RD-7 two family residential zoning district. "Sec. 28.2. Districts --Established and enumerated. For the purposes of promoting the health, safety, morals and general welfare of the inhabitants of the city, of securing safety from fire, panic and other damages, 11911 4J 1 or providing adequate light and air, of preventing over- t crowding of land, of avoiding underconcentration of 3 population, and of facili-tating the provision of adequate 4 transportation, water, sewerage disposal, parks and 5 and recreational facilities and other public requirements, 6 the corporate area of the city shall be divided into the 7 following zoning districts: g R-1 district (single-family residence). 9 R-lB district (one -family dwelling). 10 R-IC district (one -family dwelling). 11 R-2 district (two-family dwelling). 12 Rq-7 district (two-family dwelling). 13 R-3 district (low density multiple dwelling). 14 R-3U district (row houses). 1s R-4A district (planned apartment). 16 R-5 district (motel and hotel uses). 17 $-6district (residential office). 18 s-5 district (limited residential office). 19 T-1 district (trailer park). 20 S-1 district (recreational uses). 21 B-1 district (neighborhood business). B-2 district (community business). 22 23 B-3 district (general business). 24 A-5 district (agricultural excavation uses). 25 M-1 district (light industrial). 26 M-2 district (medium industrial)." 27 28 SECTION 12: Severabilit Clause: Should any section 29 or provision of this ordinance or any portion hereof, or any 30 paragraph, sentence, or word be declared by a court of competent 31 jurisdiction to be invalid, such decision shall not affect the 32 validity of the remainder hereof as a whole or any part hereof, 33 other than the part to be declared invalid. 34 SECTION 13: Repealer: All or ordinances or parts of -4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 ,8 1 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 ordinances in conflict herewith be and the same are hereby repealed, as of the effective date of this ordinance. SECTION 14: Codifications Specific authority is hereby granted to codify this ordinance. SECTION 15: Effective Date: This ordinance shall take effect immediately upon its final passage.
