HomeMy WebLinkAboutCity of Tamarac Ordinance O-1978-052Introduced by: C/M Disraelly Temp. ff 570 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 ]6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0 T 78-52 AN ORDINANCE AMENDING SECTION 28-1 OF THE TAMARAC CITY CODE BY INSERTING A DEFINITION FOR THE TERM HEIGHT, BUILDING, AND AMENDING THE DEFINITION OF DUPLEX; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY OF INVALID PROVISION; PROVIDING FOR REPEALER; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 28-1, Definitions, of the Tamarac City Code is amended to include the underscored 'language below: Sec. 28-1. Definitions. For the purposes of this chapter, the following words anc phrases shall have the meanings respectively ascribed to them by this section: 1. Accessory building. A subordinate building which is located on the same lot as the main building, the use of which building is clearly incidental to the use of the main building. 2. Accessory uses. Uses customarily incident to the permitted principal uses. 3. Apartment. "Apartment" or "apartment house" is a building occupied or intended to be occupied by more than two (2) families, living separately and with separate kitchens or facilities for doing their own cooking on the premies, or by more than two (2) families, individuals or groups of individuals. 4. Building. Any enclosure having a permanent location on the land, excepting walls, fences, and hedges not exceeding five (5) feet in height. 5. Duplex. A building divided horizontally or verti- cally and designed for or occupied by two (2) single family house- keeping units, having one roof and one dividing partition common to each unit, furthermore, at least one habitable room or garage in each unit shall adjoin for a distance not less than ten (10') feet in length. Private outdoor areas shall be provided for each unit 1 visually screened from the adjoining dwelling unit. 2 6. Dwelling, multiple -family. An apartment as defined 3 herein. 4 7. Dwelling, one -family. A detached building designed S for or occupied exclusively by one family. 6 8. Family. One or more persons living together as a 7 single housekeeping unit, supplied with a kitchen or facilities for 8 cooking on the premises. 9 9. Hei ht Buildin . Is the vertical dimension 10 measured from the average elevation of the finished lot grade at 11 the front of the building to the top of a parapet, or to the top of 12 a flat roof, or to the mid-hei ht of an an ular roof, whichever is 13 the tallest. Elevator housing and stairwells -may extend up to ten 14 (10') feet above the height of a building. 15 10. Lot. A parcel or tract of land, fronting on a street 16 which is or may be occupied by a building, and including open spaces 17 required under this chapter, which parcel or tract of land is 18 described by a plat recorded among the public records of the county. 19 11. Lot, corner. A lot abutting on two (2) or more 20 intersecting streets. 21 12. Lot depth. The distance measured from the midpoint 22 of the street lot line to the midpoint of the opposite rear lot line, 23 In the case of a corner lot, the depth shall be the longer of the 24 two (2) possibilities. 25 13,. Lot line. The lines bounding a lot. 26 14. Lot width. The average distance between side lot 27 lines, measured at right angles to the line used to determine the 28 depth of the lot. 29 15. Mixed occupancy. Occupancy of a building for more 30 than one use. 31 16. Nonconforming use. Use or occupancy of a building 32 or land not conforming to the requirements of this chapter. 33 17. Parking space. The definition of parking space or 34 off-street parking space, shall be as set forth in Section 18-3(l) - 2 - © 7_ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 of the Tamarac City Code as the same shall be amended from time to time. 18. Porch. A roofed space attached to the exterior wall of a building, open on one or more sides. 19. Setback. The minimum horizontal distance between a building and the boundary lines of the lot on which the building is located, measured at right angles to the boundary line. 20. Street. A public way affording principal means of access to abutting property. 21. Structure. Anything constructed or erected, the use of which requires permanent location on the land, except hedges, shrubs and trees. 22. Yard. An open space or area on the same lot as a building, unoccupied and unobstructed from the ground upward by any building. 23. Yard, front. The yard between the front property line and the front line of any building, measured at its least dimension and extending from one side lot line to the other, exclusive of steps, platforms, open terraces and walls not exceeding five feet in height. 24. Yard, rear. The yard extending across the full width of the lot between the rear line of any building and the rear lot line, measured at its least dimension, exclusive of steps, plat- forms,open terraces and walls not exceeding five feet in height. 25. Yard, side. The yard extending between a building and the side lot line, extending from the front yard to the rear yard, measured at its least dimension, exclusive of steps, platforms. open terraces, and walls not exceeding 'five feet in height. SECTION 2: Specific authority is hereby granted to codify this ordinance. SECTION 3: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such - 3 - 1 2 3', 4 5 6 7 8 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 I 28 29 30 31 32 33 34 decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 4: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 5: This ordinance shall become effective immediately upon its final passage.
