HomeMy WebLinkAboutCity of Tamarac Ordinance O-1978-057Introduced by: C ')rJ i Temp. #578 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-7J-, 7 AN.ORDINANCE AMENDING SECTION 27-18 WATER RATES AND 27-19 SEWER RATES OF THE TAMARAC CITY CODE BY CONTINUING THE BASE RESIDENTIAL WATER SERVICE FEE BUT IMPOSING AN ADDITIONAL FEE FOR MONTHLY RESIDENTIAL USAGE IN EXCESS OF FOUR THOUSAND GALLONS PER MONTH; INCREASING MONTHLY RESIDENTIAL AND COMMERCIAL SEWER RATES; INCREASING MONTHLY COMMERCIAL WATER RATES, ALL RATES DESCRIBED ABOVE PERTAINING TO THOSE AREAS SERVED BY THE CITY SEWAGE PLANT AND/OR RECEIVING WATER PURSUANT TO A CONTRACT BETWEEN THE CITY OF TAMARAC AND THE CITY OF FORT LAUDERDALE; IMPOSING AN ADDITIONAL SURCHARGE OF 25% FOR WATER OR SEWER SERVICE OR BOTH RENDERED OUTSIDE OF THE CITY'S CORPORATE LIMITS; REPEALING SECTION 27-7-MINIMUM CHARGE FOR DOMESTIC WATER; SECTION 27-8-CITY DIVIDED INTO TWO AREAS FOR PUR- POSES OF DETERMINING CHARGES FOR WATER PURCHASED ON UNMETERED BASIS; SECTION 27-9-AREA SUPPLIED BY FORT LAUDERDALE, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES AND RESOLUTIONS OR PARTS OF RESOLUTIONS.IN CONFLICT HEREWITH;PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS: AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac, Florida, in order to make projected revenues equal projected expenditures for water and sewer service provided, must make certain adjustments to water and sewer charges billed to those residential and commercial areas of the City of Tamarac served by the City sewage plant and receiving water pursuant to a contract between the City of Tamarac and the City of Fort Lauderdale. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Section 27-18 of the Tamarac City Code is amended as follows: 27.18.1. Effective October 1, 1978, monthly residential water rates shall be $5.00 for first 4,000 gallons of water consumed and $.85 per month for each additional 1,000 gallons of water consumed in excess of 4,000 gallons. 27.18.2. SECTION 2: Section 27-19 of the Tamarac City Code is amende to read as follows: 27.19.1, Effective October 1, 1978, monthly residential sewer charges shall be $7.45 per month. 27.19.2. Effective October 1, 1978, monthly commercial sewer rates shall be as set forth below: WATER METER SIZE 5/8" and 3/4"---$6.50 for the first 3,000 gallons of water consumed and $1,28 per 1,000 gallons of water consumed in excess of 3,000 gallons, 1"---$17.25 for the first 8,000 gallons of water consumed and $1.28 per 1,000 gallons of water consumed in excess of 8,000 gallons. 1211 ---$32.50 for the first 15,000 gallons of -water consumed and $1,28 per 1,000 gallons of water consumed in excess of 15,000 gallons. 211 ---$52.00 for the first 24,000 gallons of water consumed and $1.28 per 1,000 gallons of water consumed in excess of 24,000 gallons. 411 ---$195.00 for the first 90,000 gallons of water consumed and $1.28 per 1,000 gallons of water -2- DINO e 1 2 3 4 5, 6' rI 8 9 149A 17 18 19 20 21 23 24 25 26 MA 28 29 30 01 32 33 34 consumed in excess of 90,000 gallons. SECTION 3: Customers outside of the corporate limits of the City of Tamarac receiving water or sewer service or both, shall,in addition to the rates set forth in this ordinance,pay a surcharge of 25% on their water bill if they receive only water service, a sur- charge of 25% on their sewer bill if they receive only sewer service, or a surcharge of 25% on their water and sewer bill if they receive water and sewer service from the City. SECTION 4: Should any section or provision of this Ordinanc or any portion thereof, or any paragraph, sentence or word be de- clared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 5: Repealer - Recognizing that the ordinances included in the City Code are only those through 1976 and further recognizing that there may be some confusion concerning whether certain sections of the City Code are still effective, the following sections of the City Code are specifically repealed. 1. Section 27-7-Minimum Charge for domestic water. 2. Section 27-8-City divided into two areas for purposes of determining charges for water purchased on unmetered basis. 3. Section 27-9-Area supplied by Fort Lauderdale. Furthermore, all additional ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. ` SECTION 6: Specific authority is granted to codify this ordinance.
