HomeMy WebLinkAboutCity of Tamarac Ordinance O-1979-003Introduced by: C Temp. # 6-011T 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 CITY OF TAMARAC, FLORIDA ORDINANCE NO. b -7 p-J__ AN ORDINANCE CREATING SECTION 25-5 OF THE TAMARAC CITY CODE WHICH WILL REQUIRE THAT DURING CONSTRUCTION OF A SWIMMING POOL WATER BE PUMPED FROM THE EXCAVATION TO THE NEAREST CATCH BASIN OR TO ANOTHER STRUCTURE WHERE SEDIMENT CONTAINED IN THE WATER CAN BE TRAPPED AND PHYSICALLY REMOVED TO A LAND FILL AREA AND PROHIBITING PUMPING OF WATER AND SPILLAGE INTO A YARD OR GRASS SWALE WITHOUT PROVISIONS BEING MADE TO TRAP THE SEDIMENT INTO A CONFINED AREA AND REMOVE THE SEDIMENT DAILY; REQUIRING CONTRACTORS TO POST A $200.00 CASH BOND WITH THE CITY TO INSURE THAT THE AREA WHERE THE WATER IS PUMPED DURING CONSTRUCTION OF A SWIMMING POOL IS LEFT CLEAN OF ALL SEDIMENT; PROVIDING FOR A MANNER OF RELEASE OF SAID BOND; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, during the construction of swimming pools,excavatior must be dewatered and this water must be pumped into an accessible drainage area. Often this drainage area is just a flat yard or a grassed swale where the sediments contained in the pumped water drop out of suspension and silt up in the swale or the yard or the developer pumps his water into a catch basin and the sediment builds up there. Frequently, when the pool construction is completed pool builders do not go back and properly clean up and remove this sediment which builds up. Accordingly, it is necessary for the City of Tamarac to impose certain regulations to guarantee proper clean up and removal of sediment. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 25-5 is hereby created and shall read as follows: Section 25-5. Pumped Water Sediment Removal. During construction of a swimming pool, any water that is pumped from the excavation shall be carried by means of a hose to the nearest catch basin or to another structure or area where the sediment contained in the water can be trapped and physically re- moved to a land fill area. Water may not be pumped or spilled into a yard or a grassed swale or street right-of-way by a swimming pool contractor or other individual without provisions being made Is 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 to trap the sediment in a confined area and for the sediment to be removed daily. Further, the water must be carried to a drain in a manner approved by the Plumbing Inspector. As a prerequisite to the issuance of any permit for a swimming pool, the contractor or owner must post with the City a $200.00 cash bond. This bond is in addition to all other fees applicable to the construction of a swimming pool. This bond will insure that the areas where the water is pumped whether it is to yards, grass swales or city catch basins is left clear of all sediment. The bond will be released when the City Engineer certifies clean up is satisfactory. This final inspection by the City Engineer of the clean up of the pumped water will be a necessary prerequisite to the issuance of a certificate of occupancy for the pool. SECTION 2: Specific authority is hereby granted to codify this ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 4: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 5: This ordinance shall become effective immediately upon its passage. PASSED FIRST READING this day of aim 11978.
