AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES; PROVIDING
FOR THE REZONING OF CERTAIN REAL PROPERTY FROM R-3 AND
R-3U TO RD-7 DESCRIBED AS PORTIONS OF TRACTS 9 AND 10,
FORT LAUDERDALE TRUCK FARMS SUBDIVISION OF SECTION 9,
TOWNSHIP 49 SOUTH, RANGE 41 EAST, AS RECORDED IN PLAT
BOOK 4, PAGE 31 OF THE PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA (OTHERWISE IDENTIFIED AS BEING THOSE LANDS
ADJACENT TO TAMARAC UTILITIES AND EAST OF TAMARAC FAIRWAYS
ON THE NORTH SIDE OF N.W. 61st STREET AND THOSE LANDS ON
THE SOUTH SIDE OF N.W. 61st STREET EXTENDING EAST FROM THE
CANAL TO A POINT 465 FEET WEST OF UNIVERSITY DRIVE);
PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO
REFLECT SUCH CHANGE; PROVIDING FOR SEVERABILITY; PROVIDING
FOR AN EFFECTIVE DATE.

WHEREAS, pursuant to the instruction of the City Council of
13
the City of Tamarac, Florida, public notice has been given in ac-
14
cordance with the applicable law of the time and place of public
15
hearing regarding the zoning of the property described herein and
16
the said public hearing has been held in accordance with the notice
17
and the public has been given an opportunity to be, and has been
i
18.
heard; and the Council has examined and investigated the request for

the zoning herein and has received the recommendation of the Planninc
20
Commission of the City of Tamarac; and
21
WHEREAS, public hearing has been held on Petition #30-Z-78
22
by the City Council pursuant to the Charter.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
24
TAMARAC, FLORIDA:

SECTION 1: That those lands described in Exhibit "A"
26
attached hereto and made a part hereof are hereby rezoned from R-3
27
and R-3U to RD-7 classification.

SECTION 2: That the Official Zoning Map of the City of
29
Tamarac shall be changed to reflect this change in the zoning, said
(
30
changes to be initialed by the Mayor and the City Clerk, together
31
with the effective date of this Ordinance.

SECTION 3: All ordinances or parts of ordinances in
33
conflict herewith are hereby repealed to the extent of such
34
conflict.

SECTION 4: Should any section or provision of this
ordinance or any portion thereof, or any paragraph, sentence or word
be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or any part hereof, other than the part declared to be invalid.
SECTION 5: This ordinance shall become effective imme-
diately upon its final passage.
