AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES; PROVIDING FOR THE REZONING FROM B-3 TO S-1 OF CERTAIN REAL PROPERTY DESCRIBED AS PARCEL S-1, FLORIDA FRUIT LANDS COMPANY SUB- DIVISION NO. 2 OF SECTION 5, TOWNSHIP 49 SOUTH, RANGE 41 EAST, AS RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA (OTHERWISE IDENTIFIED AS A 50-FOOT STRIP OF LAND LYING ALONG THE NORTH SIDE OF N.W. 81st STREET EXTENDING WESTWARD FROM N.W. 88th AVENUE TO THE CANAL AND A STRIP OF LAND MEASURING 100 FEET WIDE EXTENDING NORTH- WARD ALONG THE EAST SIDE OF SAID CANAL TO SOUTHGATE BOULE- VARD); PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accor- dance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and.investigated the request for the zoning herein and has received the recommendation of the Planning Commission of the City of Tamarac; and WHEREAS, public hearing has been held on Petition #32-Z-78 by the City Council pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION l: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby rezoned from B-3 to S-1 classification. SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect this change in the zoning, said changes to be initialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. SECTION 3: All ordinances or parts of ordinances in con - flirt herewith are hereby repealed to the extent of such conflict. ac 11�E71 SECTION 4: Should any section or provision of this ordi- nance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
