ORDINANCE NO. Q- 79-33_
AN ORDINANCE AMENDING SECTION 11-18 OF THE
TAMARAC CITY CODE TO REQUIRE APPLICANTS FOR
GARBAGE COLLECTION FRANCHISES AND RENEWAL OF
GARBAGE COLLECTION FRANCHISES TO POST AN
APPLICATION FEE OF $150.00 TO COVER ANNUAL
ADMINISTRATIVE PROCESSING COSTS; PROVIDING FOR
CODIFICATION; PROVIDING FOR SEVERABILITY OF
INVALID PROVISION; PROVIDING REPEALER AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: Section 11-18 of the Tamarac City Code is hereby
amended to insert the words underscored and delete the words struck through
as follows:
Sec. 11-18. Same - Franchise agreement and,Fees - Required
Any person desiring to engage in the business of collecting
garbage and trash in the city shall, before commencing in or
soliciting such business, enter into a franchise agreement with
the city. Eachapplicant fora garbage collection franchise or
franchise renewal shall submit with his application a non-
refundable fee of $150.00 which shall cover necessar
administrative costs.
SECTION 2: Specific authority is hereby granted to codify this
ordinance.
SECTION 3: Should any section or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be declared by a court
of competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
SECTION 4: All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.
SECTION 5: This ordinance shall become effective immediately
upon its final passage.
