CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 4
AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE No. 79-26
PERTAINING TO PRIVATE STREETS BY ALLOWING GUARD HOUSES
TO BE INSTALLED AND SETTING FORTH TERMS AND CONDITIONS
FOR APPROVAL AND CONSTRUCTION OF SAID GUARD HOUSES;
PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: Section 2 of Ordinance No. 79-26 is amended by inserting
a new paragraph 15 which will read as follows:
15. Guard houses may be constructed adjacent to private
streets. These guard houses may be installed within setbacks provided that
they are at least feet from the edge of the pavement of the private street
and do not encroach in any utility easements. Each proposed guard house must
be approved in advance by the City Council which shall consider the location
of the guard house and architectural renderings of such guard house. The
Council will not and shall not approve any guard house which it finds to be
aesthetically unpleasing and not in conformity with the architecture of the
surrounding development. There will be no plain, wooden slat _ guard houses.
If a guard house is abandoned the continued maintenance shall rest with the owners
of the residences adjacent to the private streets served by that guard house.
Maintenance of each guard house must be specifically provided in Homeowners'
I Association documents.
SECTION 2: Specific authority is hereby granted to codify this
I Ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this Ordinance or any
portion hereof or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
SECTION 5: This ordinance shall become effective immediately upon
its final passage.
