3 AN ORDINANCE AMENDING SECTIONS 6 AND 8 OF ORDINANCE NO.
78-50 PERTAINING TO FEES FOR WATER METER DEPOSITS WITHIN
4 THE CITY'S WATERWORKS SYSTEM: INCREASING CERTAIN CONNECTION
CHARGES FOR NEW CONNECTIONS FOR 5/8" AND 3/4" LINES; PRO-
VIDING FOR REFUND OF PORTION OF CERTAIN WATER METER DEPOSITS;
PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING
b FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN
EFFECTIVE DATE.

8 WHEREAS, the City of Tamarac received a Federal Grant to assist in
9 the cost of water meter installation for those residents served by the City's
10 Water and Sewer System; and
11 WHEREAS, the grant did not pay the entire cost of the project; and
12 WHEREAS, it was necessary for the City to impose by ordinance a
13 $60.00 fee for expenses not covered by the grant; and
14 WHEREAS, the $60.00 fee represented the best estimate of projected
15 costs; and
16 WHEREAS, the laudable diligence of the City staff enabled the
17 completion of water meter installation at substantially less than projected
18 costs; and
19 WHEREAS, the City Council wants to refund the bulk of unexpended
20 water meter monies received in conjunction with the installation project.
21 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
22 TAMARAC, FLORIDA:
23 SECTION 1: Section 6 of Ordinance 78-50 is amended by adding the
24 words, numbers and punctuation underscored and deleting the words, numbers and
25 punctuation struck through as follows:
26 Section 6. Fees for connection to water system.
27 The following connection charges shall apply to bring the
28 water distribution service line to the owner's property line:
29 5/8" & 3/4" $100.00 $6mg
30 1 $150.00
31 $210.00
32 2" $300.00
33 Any meter size over 2" actual cost of installation

1 SECTION 2: Section 8 of Ordinance No. 78-50 is amended by adding
2 the words, numbers and punctuation underscored and deleting the words,
3 numbers and punctuation struck through as follows:
4 SECTION 8:
5 Each business or residence served by the City's waterworks
6 system must have and pay for a water meter which meter remains the
7 property of the City and is not transferable to another residence
8 or business site. This meter is to be used for measuring flow.

25 SECTION 3: The staff of the City.of Tamarac is directed to refund
26 as quickly as possible to each residential customer who paid $60.00 for water
27 meter installation the sum of $16.00. If the individual who made the payment is
28 not a current customer of the City's waterworks system, payment shall be made to
29 that individual provided a claim for payment is made within one year of the
30 effective date of this ordinance. There shall be no fee for application for
31 this refund. Any monies not claimed within the one-year period shall be placed
32 in the general operating account of the City's waterworks system.
33 SECTION 4: Specific authority is hereby granted to codify Sections 1& 2
34 of this ordinance.

SECTION 5: All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of such conflict.
SECTION 6: Should any section or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not affect
the validity of the remainder hereof as a whole or any part hereof other than
the part declared to be invalid.
SECTION 7: This ordinance shall become effective immediately
upon its final passage.
