HomeMy WebLinkAboutCity of Tamarac Ordinance O-1979-047Introduced by:1%7dz" C�u� Temp.#652- CITY OF TAMARAC, FLORIDA 1 2 3 4 5 6 7 ORDINANCE NO. 0-79-47 AN EMERGENCY ORDINANCE SETTING FORTH MINIMUM DRAINAGE REQUIREMENTS FOR DEVELOPMENT WITHIN THE CITY OF TAMARAC AND ESTABLISHING A FEE FOR DRAINAGE IMPROVEMENTS AT THE TIME A SITE PLAN IS APPROVED, AND ALLOWING FOR PRE- PAYMENT OF SAID FEES; SETTING FORTH BASIS FOR EMERGENCY; PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PRO- VIDING FOR SEVERABILITY OF INVALID PROVISIONS AND PRO- VIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: B SECTION 1: FINDING OF EMERGENCY 9 The rains of April, 1979, underscored the vital and immediate 10 need for additional water storage areas within the City of Tamarac. The City 11 has engaged the University of Florida to study drainage in Tamarac and after the 12 staff and City Council have reviewed this study, the conclusion has been 13 reached that a minimun standard for on site water retainage must be established 3.4 throughout the City. Acknowledging the existing hurricaneseason and proposed 15 development, it is imperative that said development be subject to the minimum 3 6 standards set forth herein. 17 SECTION 2: In addition to existing regulations, site plans 1$ considered by the City Council subsequent to the effective date of this ordinance 19 shall show 9125 cubic feet of additional storm water retainage per acre of 20 development below the elevation of 10.0. This additional retention shall be 21 provided in open lakes and canals directly extending from existing canals and 22 lakes or connected to existing canals and lakes by a 72 inch culvert not more than 23 200 feet in length. For the purpose of measurement, each acre of water surface 24 added will be considered as providing 182,500 cubic feet of additional retention. 25 Said acreage shall be computed at the design water surface elevation. Said 26 elevation is to be considered 6.30 MSL. In cases where there would be an undue 27 hardship to provide open canals or lakes, upon the recommendation of the City 28 Engineer, the City Council may accept other methods of providing the required 29 retainage. An undue hardship shall be defined as any situation where the 30 distance between a parcel and an existing canal or lake is more than 200 feet. 31 ` Furthermore, in addition to any other fee, each developer seeking approval of a 32 site plan shall pay a fee of $130 per acre for drainage improvements for each 33 acre of land sought to be developed at the time of approval of a site plan. This 34 fee may be prepaid in which event City shall not charge the developer an in- creased fee at the time of site plan approval. SECTION 4: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 5: Should any section or provision of this Ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the. part declared to be invalid.
