CITY OF TAMARAC, FLORIDA
ORDINANCE NO. %9rSI
AN ORDINANCE LIMITING THE NUMBER OF COMMERCIAL GARBAGE
FRANCHISES WHICH MAY BE ISSUED WITHIN THE CITY OF
TAMARAC; PROVIDING FOR CODIFICATION; PROVIDING FOR
SEVERABILITY OF INVALID PROVISIONS; PROVIDING RE-
PEALER; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: There is hereby established a limitation of the number
of commercial garbage franchises which may be issued by the City of Tamarac,
Florida, which number is hereby established at seven (7). The standards to be
-considered for granting said franchisesshall be:
1. Past satisfactory performance within the City of
Tamarac;
2. Past satisfactory performance within Broward
County, Florida;
3. Ability to satisfy all prerequisites to the
issuance of a franchise.
4. Such other factors affecting performance
determined by the City Council.
SECTION 2: Specific authority is hereby granted to codify this
ordinance within Chapter 11 of the Tamarac City Code entitled Garbage, Refuse
and Weeds.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance or
any portion hereof or any paragraph, sentence or word be declared by a Court
of competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
SECTION 5: This ordinance shall become effective upon its
final passage.
