S 3 AN ORDINANCE WAIVING PLATTING REQUIREMENTS AS A PRE- REQUISITE TO OBTAINING A BUILDING PERMIT OR SITE 4 PLAN APPROVAL FOR THAT PROPERTY DESCRIBED AS A PORTION OF TRACT 9, OF FORT LAUDERDALE TRUCK FARMS 5 SUBDIVISION OF SECTION 9, TOWNSHIP 49 SOUTH, RANGE 41 EAST, AS RECORDED IN PLAT BOOK 4, PAGE 31, OF 6 THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LOCATED NORTH OF TAMARAC UTILITIES MAIN PLANT, 7 WEST OF UNIVERSITY DRIVE BETWEEN 61ST STREET AND CONCORD VILLAGE; SETTING FORTH BASIS FOR WAIVER; B GRANTING EXCEPTION PERMIT WITHOUT NECESSITY OF ADDITIONAL ROAD DEDICATION; PROVIDING FOR NON- 9 SEVERABILITY OF INVALID PROVISIONS; PROVIDING REPEALER; PROVIDING AN EFFECTIVE DATE. 10 11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 12 SECTION 1: FINDING OF FACT AND BASIS OF WAIVER 13 1.1 That parcel of property described in Exhibit 1 is approximately 14 one acre more or less on which is constructed a building that has been used 15 by the American Video Corporation. ]6 1.2 The only access to the property is via a 20 foot dedicated 17 roadway which uses the entire 20 foot right-of-way. 18 1.3 The property is not platted and city regulations require 19 platting before a building permit can be issued. 20 1.4 Interior work on the building requiring a building permit is 21 needed, yet it is not feasible for the property owner to acquire additional 22 right-of-way in order to widen the road. 23 1.5 If the road was not already dedicated and if it did not border 24 on property owned by other parties, the road could be considered a driveway. 25 1.6 Section 5.02 of the Broward County Land Use Plan's Implementation 26 Section requires platting in certain instances, but not for this property. 27 1.7 Exception Permit waiving platting may be granted under certain 28 conditions set forth in Section 20-4 of the City Code yet there is a requirement 29 that no additional right-of-way is needed under City regulations. Technically, 30 additional right-of-way is needed for this property. 31 1.8 A unique situation exists concerning the property and the City 32 Council is of the opinion that no additional right-of-way or wider roadway is 33 needed to serve the property if the existing building is not enlarged. 34 SECTION 2: All platting requirements which are a prerequisite to 1 1 L�] 1 the issuance of a building permit and which exist for site plan approval concern- 2 ing the property described in Exhibit 1 hereof are hereby waived provided that 3 for so long as there is no expansion in size of the existing structure on said 4 property, and that no additional structure is constructed thereon. S SECTION 3: An Exception Permit is granted for the property in 6 Exhibit 1 provided that there is no expansion in size of the existing structure 7 on said property and that no additional structure is constructed thereon.
