CITY OF TAMARAC, FLORIDA
ORDINANCE NO. -
AN EMERGENCY ORDINANCE ADOPTING THE REVENUE FUND;
SINKING FUND BOND SERVICE ACCOUNT; SINKING FUND
RESERVE ACCOUNT; RENEWAL AND REPLACEMENT FUND;
GENERAL RESERVE FUND; CONSTRUCTION FUND; AND
INTEREST AND PRINCIPAL FUND OF THE CITY OF TAMARAC
WATER AND SEWER SYSTEM WEST OF STATE ROAD 7;
STATING THE BASIS OF EMERGENCY; PROVIDING FOR
AUTOMATIC EXPIRATION OF ORDINANCE; PROVIDING FOR
SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: Finding of Emergency.
The City of Tamarac has agreed to purchase Tamarac Utilities, Inc.
Under the terms of the Purchase and Sale Agreement between the City and Tamarac
Utilities a referendum was to be held within 75 days of the date of execution
and if the referendum was successful, closing was to be held within three (3)
days of the date of certification of the election. The electorate votea in
favor of the acquisiton on October 9, 1979 and closing is scheduled to occur
on October 15, 1979. Tamarac must enact a budget for the operation of the system
and time constraints make it impossible to enact a budget of any sort by any
method other than by emergency ordinance. However, the City Council realizes
the need and the necessity to allow its citizens the opportunity to review and
provide input concerning the proposed budget and accordingly, it will enact a
temporary budget in order that a Public Hearing may be held on the final budget
at a later date.
SECTION 2: That the annual Revenue Fund Budget of the Utility serviing '
customers West of State Road 7 of estimated expenses and receipts for the fiscal
year 1979/80 reflecting the total revenues of $4,194,600.00 and.
expenditures of $4,194,600.00 as set forth in Exhibit A,attached hereto and
made a part hereof as fully as if set forth verbatim herein,be and the same is
hereby adopted and approved by the Council of the City of Tamarac as the Revenue
Fund Budget for the fiscal year 1979/80. Also adopted by reference as part of
said budget is the budget detail dated October 11, 1979 which sets forth each
line item in this budget.
SECTION 3: That the Sinking Fund Eond Service Account Budget of
the Utility serving customers West of State Road 7 of estimated expenses and

receipts for the fiscal year 1979/80 reflecting the total revenues of
$851,625.00 and expenditures of $851,625.00 as set forth in Exhibit B,
attached hereto and made a part hereof as fully as if set forth verbatim
herein, be and the same is hereby adopted and approved by the Council of the
City of Tamarac as the Sinking Fund Bond Service Account Budget for the
fiscal year 1979/80.
SECTION 4: That the Sinking Fund Reserve Account Budget of
the Utility serving customers West of State Road 7 of estimated expenses and
receipts for the fiscal year 1979/80 reflecting the total revenues of
$1,329,000.00 and expenditures of $1,329,000.00 as set forth in Exhibit C,
attached hereto and made a part hereof as fully as if set forth verbatim
herein, be and the same is hereby adopted and approved by the Council of the
City of Tamarac as the Sinking Fund Reserve Account Budget for the fiscal
year 1979/80.
SECTION 5: That the annual Renewal and Replacement Fund Budget of
the Utility serving customers West of State Road 7 of estimated expenses and
receipts for the fiscal year 1979/80 reflecting the total revenues of
$523,000.00 and expenditures of $523,000.00 as set forth in Exhibit D,
attached hereto and made a part hereof as fully as if set forth verbatim
herein, be and the same is hereby adopted and approved by the Council of the
City of Tamarac as the Annual Renewal and Replacement Fund Budget for the
fiscal year 1979/80.

SECTION 6: That the annual General Reserve Fund/of the Utilitv
serving customers West of State Road 7 of estimated expenses and receipts for
the fiscal year 1979/80 reflecting the total revenues of $302,600.00 and
expenditures of $302,600.00 as set forth in Exhibit E, attached hereto and
made a part hereof as fully as if set forth verbatim herein, be and the same
is hereby adopted and approved by the Council of the City of Tamarac as the Annual
General Reserve Fund Budget for the fiscal year 1979/80.

SECTION 7: That the annual Construction Fund/of the Utility
serving customers West of State Road 7 of estimated expenses and receipts for
the fiscal year 1979/80 reflecting the total revenues of $1,519,000.00 and
expenditures of $1,519,000.00 as set forth in Exhibit F, attached hereto and
made a part hereof as fully as if set forth verbatim herein, be and the same

is hereby adopted and approved by the Council of the City of Tamarac as the
Construction Fund Budget for the fiscal year 1979/80.
SECTION 8: That the Annual Interest and Principal Fund Budget
of the Utility serving customers West of State Road 7 of estimated expenses
and receipts for the fiscal year 1979/80 reflecting the total revenues of
$257,300.00 and expenditures of $257,300.00 as set forth in Exhibit G,
attached hereto and made a part hereof as fully as if set forth verbatim
herein, be and the same is hereby adopted and approved by the Council of l:he
City of Tamarac as the Annual Interest and Principal Fund Budget for the
fiscal year 1979/80.
SECTION 9: Transfers shall be in accordance with Resolution
Nos. 79-45-7, and 79 �1.5-,4 authorizing the issuance of Bonds and Bond Anticipation
Notes for the acquisition of the Utility.
SECTION 10: This Ordinance shall be of the temporary duration
of six (6) months from its adoption. Thereafter, it shall be'deemed automatically
expired.
SECTION 11: This Ordinance shall be effective on October 15,
1979, or immediately upon the acquisition of the assets of Tamarac Utilities,
Inc., whichever is later.
SECTION 12: Should any section or provision of this Ordinance
or any portion hereof or any paragraph, sentence or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not affect
the validity of the remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
