HomeMy WebLinkAboutCity of Tamarac Ordinance O-1979-063Introduced by: C/r,/-�a�-��l.,� Temp. # 6 7/ 1 r 1 CITY OF TAMARAC, FLORIDA Z ORDINANCE NO. jQ- 79-6 3 3 AN ORDINANCE AMENDING ORDINANCE NO. 73-36 AS AMENDED BY ORDINANCE NO. 76-86 AND BY ORDINANCE NO. 79-52 PERTAINING TO CABLE TELEVISION BY AMENDING SECTION 11 OF ORDINANCE NO. 5 73-36 WHICH PERTAINS TO COMPENSATION TO THE CITY BY AMERICAN VIDEO OF TAMARAC, INC. BY MODIFYING THE FEES DUE THE CITY b AND CHANGING THE TIMING OF PAYMENTS; PROVIDING REPEALER; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PRO- 7 VIDING AND EFFECTIVE DATE. 8 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 9 SECTION 1: That Section 11 of Tamarac Ordinance No. 73-36,as amended, 3-0 .is hereby amended to insert the word, figures and punctuation underscored and 11 delete the words, figures and punctuation struck through as follows: 12 SECTION 11: CITY COMPENSATION. The Company will pay to the 3.3 City an annual fee equal to 5% of the gross revenue derived by the 14 Company from its monthly CATV subscriber charge: or a fee in the amount 15 of $20,000.00 er annuM, whichever sum is greater. ]6 A. In keeping with the above section dealing with City 17 compensation, and as of the close of business at the end of the Company' 18 fiscal ea}eRd ar year, the Company shall compile a report of the annual 19 gross receipts from subscribers within the City, certified to by a 20 certified public accountant. The report, together with the amount due 21 the City, shall be delivered to the City Clerk within ninety (90) days 22 following the close of such fiscal ealendar year. The first payment due 23 the CitX shall commence on July 1, 1981 for the fiscal year commencing 24 on July 1, 1980. 25 SECTION 2: Should any section or provision of this Ordinance or any 26 portion hereof or any paragraph, sentence or word be declared by a Court of 27 competent jurisdiction to be invalid, such decision shall not affect the validity 28 of the remainder hereof as a whole or any part hereof other than the part declared 29 to be invalid. 30 SECTION 3: All ordinances or parts of ordinances in conflict herewith 31 are repealed to the extent of such conflict. 32 SECTION 4: This Ordinance shall be effective upon acceptance by 33 American Video.
