AN ORDINANCE AMENDING SECTION 7-30(d) OF THE
TAMARAC CITY CODE AS ENACTED BY ORDINANCE NO.

78-19 PERTAINING TO CONSTRUCTION AND LOCATION
STANDARDS FOR EXTERIOR TRASH ENCLOSURES BY
5
MODIFYING REQUIREMENTS FOR THE CONSTRUCTION OF
SAID ENCLOSURES; PROVIDING FOR CODIFICATION;
6
PROVIDING REPEALER; PROVIDING FOR SEVERABILITY
OF INVALID PROVISIONS; AND PROVIDING AN

EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:

SECTION 1: Section 7-30(d) of the Tamarac City Code is amended
10
by adding the words underscored and deleting the words struck through as follows:

Section 7-30(d) Construction and Location Standards: All
12
exterior trash enclosures in new developments or requested revisions in existing
13
developments, or upon request for a new or renewed occupational license in-

volving the retail or wholesale consumption, manufacturing, sale or storage of
15
food or food products shall be required to comply with the following standards:
16
(1) It is the responsibility of the proposed user to identify
17
the number, size and material of all trash containers and enclosures, either
18
known or generally estimated, on the Preliminary Site Development Plans sub-

mitted to Tamarac for development or building permits.

(2) All trash receptacles shall be required to be shielded by
21
solid masonry walls (stuccoed and painted) and solid gates. However, each
22
exterior trash enclosure approved after 1979, the effective
23
date of this ordinance shall have a 30 inch opening on one side which shall be
24
used to enable a person to walk into the enclosure to deposit trash. There
25
shall be a step or steps which would enable an individual to reach the to of
26
the dum ster itself and a wheel stop shall be installed within the enclosure
27
to prevent the dum ster from rolling and coveting the step. This opening and
28
step are for the purpose of allowina side entry into the dum ster area so that
29
small items of trash may be more easily disposed of without the need open the

gate. (3) The height of the walls and gates shall be as follows:

Up to 6 cu. yd. container --- 6' high

Up to 8 cu. yd. container -'-- 8' high

(4) The minimum inside dimensions of the enclosure shall be
34
three (3) feet wider than the overall width of -the receptacle and two (2) feet
deeper.

than the depth. If the size of the receptacle is unknown, then the minimum
size of a proposed enclosure shall be no less than 10' by 10' (inside
dimensions) with 6' high walls.
(5) The gates of the enclosure shall have no panel wider than
6' and be constructed of a material of sufficient strength to withstand
normal daily use of rubbish disposal and pickup. Chain link gates with slats
are not permitted. Solid metal posts shall be placed in front of the gate
hinges. However, hinges may be attached to the posts.
(6) The base of the enclosure is to be concrete with a minimum
of 4" in depth.
(7) The enclosures shall be permitted to encroach into the
side and rear setbacks up to three (3) feet from the property line when the
abutting property is zoned B-1, B-2, B-3 or M-1. When the enclosure is
placed adjacent to property lines abutting all other districts, the setbacks
shall be the same dimensions as for the principal buildings.
(8) All dumpsters located within a building shall be in trash -
rooms provided with an automatic sprinkler, washing facilities and
deodorizing system.
(9) The trash receptacles and enclosures shall be located in
a position convenient to pickup by front-end and back -end loaders.
SECTION 2: Specific authority is hereby grante4, to codify
this ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.
SECTION 4: Should any section' or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof'Ias a whole or any part hereof
other than the part declared to be invalid.
SECTION 5: This ordinance shall become effective upon its
final passage.
