AN ORDINANCE AMENDING SECTION 24-3 OF THE TAMARAC CITY
CODE BY INSERTING A DEFINITION OF SUUE AND BY AMENDING
SECTION 24-23(a)(2) OF THE TAMARAC CITY CODE BY CLARIFYT14G
THE REQUIREMENT' FOR DEVELOPERS TO PREPAY ESTIMATED
MAINTENANCE AND SERVICE CHARGES FOR

TIONS: PROVIDING FOR CODIFICATION; PROVIDING REPEPIER;
PROVIDING FOR SEVERABILITY OF 1I.WALID PROVISIONS; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That Section 24-3 of the Timnarac City Code is amended
by adding the following definition which shall be inserted within that Section in
the appropriate place so that all definitions shall continue to be in alphabetical
order:
Swale: A slope, hollow or depression in land creating a drainage
channel for directing flow of storm water runoff.
SECTION 2: Section 24-23(a)(2) of the Tamarac City Code is hereby
amended by adding the words, numerals and punctuation underscored, and by deleting
the words, numerals and punctuation struck through as follows:

The first twelve (12) months of estimated maintenance and servicE
charges for the street lighting system, shall be paid for the
project by the Developer before the issuance of
a building permit. In cases where the estimated completion timE
of a project exceeds twelve (12) months the Council ma Ee uire
payment of additional maintenance and service charges until such
time as the Council releases the-oublic improvement bond.
SECTION 3: Specific authority is hereby granted to codify this

2 with are repealed to the extent of such conflict.
3 1SECTION 5: Should any section or provision of this ordinance or any
4 paragraph, sentence or word be declared by a Court of competent jurisdiction to be
5 invalid, such decision shall not affect the validity of the remainder hereof as a
whole or any part hereof other than the part declared to be invalid.
SECTION 6: This ordinance shall became effective immediately upon
