HomeMy WebLinkAboutCity of Tamarac Ordinance O-1982-002Introduced by Temp. # 944 Petitions' -V� 1 2 3 4 5 8 9 10 11 12 13 14 15 .b 17 21 22 23 24 25 26 27 28 29 --)n 03.4 33 34 35 36 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0 AN ORDINANCE VACATING A 12—FOOT WIDE EASEMENT LOCATED ON A PORTION OF PARCEL "A", "SABAL PALM VILLAGE OF TAMARAC", IN SECTION 12, TOWNSHIP 49 SOUTH, RANGE 41 EAST, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 79, AT PAGE 42, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (OTHERWISE IDENTIFIED AS BEING LOCATED ON THE EAST SIDE OF SABAL PALM BOULEVARD NORTH, NORTH OF AND ADJACENT TO SABAL PALM CONDOMINIUMS); PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA-- SECTION 1: FINDING OF FACT A determination is hereby made by the City Council that the easement described in Exhibit "A" is no longer needed for public purposes and, accordingly, the easement interest shaald revert to the private party(ies) owning the property burdened b_v the easement to be vacated. SECTION 2: The easement described in Exhibit "A" attached hereto and made a part hereof, is hereby abandoned, vacated and extinguished by the City Council of thel City of Tamarac, Florida, and such easement shall no longer be deemed property to be used for public purposes on behalf of the people of the City of Tamarac, Florida. SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
