O- AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM R-4A (PLANNED APARINIENTS - 15 DWELLING UNITS PER ACRE) TO M-10 (PLANNED APARTMMM - 10 DWELLING UNITS PER ACRE) DESCRIBED AS A PORTION PARCEL "R" OF WOODLAND LAKES PLAT, AS RECORDED IN PLAT BOOK 71, AT PAGE 18 OF THE PUBLr1C RECORDS OF BRO M COUNTY (OTHERWISE IDENTIFIED AS THOSE LANDS AT THE SOUTHEAST CORNER OF 14W 88 AVENUE AND MCNAB ROAD AND EXTENDING EASTWARD APPROXIMATELY 870-FEET); PROVIDING FOR AN=vIENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR SE'VERABILITY; PROVIDING AN EFFECTIVE DATE WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and investigated the request for the zoning herein and has received the reccm endation of the Planning Ccamussion of the City of Tamarac; and WHEREAS, public hearing has been held on Petition #28-Z-81 by the City Council, pursuant to the Charter. FWRYDA: NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, SECTION 1: That those lands described in ildiibit "A" attached hereto and made a part hereof are hereby rezoned from R-4. (Planned Auartments - 15 dwelling units per acre) to RM-10 (Planned Apartments - 10 dwelling units per acre). SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect in the zoning, said changes to be initialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: Should any section or provision of. this Ordinance or any portion thereof, or any paragraph, sentence or word be declared b;T a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of 3311 3 the remainder hereof as a whole or any part hereof, other than the tart declared to 34 be invalid. 35 36 1 SECTION 5: This Ordinance shall become effective immediately upon 2 its final passage. 3 4 PASSED FIRST READING this day'of , 1982. (Otherwise identified as being those lands at the southeast corner of NW 88th Avenue and McNab Road.and extending eastward approximately 870 feet.) 0
