HomeMy WebLinkAboutCity of Tamarac Ordinance O-1982-016Introduced by Temp. # 955 Rev. 2/19/82 Rev. 3/9/82 1 2 3 4 5 1; 7 8 9 10 11 12 13 14 15 16 17 .3 3 20 21 22 26 27 28 29 30 32 33 34 35 36 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0--p AN ORDINANCE VACATING A PORTION OF A CANAL RIGHT-OF-VMY COMPLETELY SURROUNDED BY BLOCK 46, ADJACENT TO LOT 4, "THE WOODLANDS SECTION EIGHT", ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 67, AT PAGE 42 OF THE PUBLIC RECORDS OF BROWARD COUNTY; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: FINDING OF FACT. A determination is hereby made by the City Council that the right-of-way described in Exhibit "A" is no longer needed for public purposes and, accordingly, ownership should revert to the private party(ies) owning the property abutting the canal right-of-way to be vacated, and that the property should thus be added to the County's tax rolls. SECTION 2 The right-of-way described in Exhibit "A" attached hereto and made a part hereof, is hereby abandoned and vacated by the City Council of the City of Tamarac, Florida, and such right-of-way shall no longer be deemed property to be used for public purposes on behalf of the people of the City of Tamarac, Florida. SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 4: This Ordinance shall become effective upon final adoption. PASSED FIRST READING this day of 1982. PASSED SECOND READING this/01-z�ay of1982.
