CITY OF TAMARAC, FLORIDA
ORDINANCE NO.,-_&-.3,3
AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, REGULATING
THE POSSESSION OF TEFLON-COATED BULLETS KNOWN AS "KTW
BULLETS" IN THE CITY OF TAMARAC, FLORIDA; PROVIDING FOR
DEFINITIONS OF TEFLON-COATED BULLETS KNOWN AS "KTW
BULLETS"; PROVIDING FOR THE REGULATION, POSSESSION AND USE
OF SAME; PROVIDING FOR PENALTIES; PROVIDING FOR
CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR
SEVERABILITY OF INVALID PROVISION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, it has come to the attention of the City Council that there
currently exists in the market place a teflon coated bullet known as the "KTW
Bullet" which is capable of penetrating a standard 16-ply Kevlar police -type
bullet-proof vest used by law enforcement officers in the City of Tamarac,
Broward County and in the State of Florida; and
WHEREAS, the City Council finds and determines that the KTW Bullet
possesses the physical characteristics and capabilities to penetrate steel,
engine blocks and various other substances to the significant and substantial
detriment of law enforcement officers in the City of Tamarac, in Broward
County and in the State of Florida; and
WHEREAS, the KTW Bullet, its possession and use by non -law
enforcement officers in the City of Tamarac poses a monumental and grave
threat to the health, safety, welfare and the very lives of law enforcement
officers and the citizens and residents of the City of Tamarac, Florida; and
WHEREAS, the City Council finds and determines that there is no
practical reason or basis to condone the possession and use of KTW Bullets in
circumstances other than law enforcement and related fields and that such
possession and use of KTW Bullets in the hands of non -law enforcement users is
a matter within the police powers of the City of Tamarac and consistent with
the preservation of the health, safety and welfare of the citizens and
residents of the City of Tamarac.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: DEFINITIONS
A. The type and kind of bullets proscribed for use and possession in
accordance with this Ordinance shall be defined as any and all teflon-coated
bullets known presently as "KTW Bullets", or any other brand, make, type or
product manufactured by any person, firm or corporation in like manner.
B. The aforementioned teflon-coated bullets may be constructed and
manufactured:
1. from extremely hard metal of varying types either from
tungsten steel or in conventional steels in a substantially undersized form so
that the hard steels cannot come into contact with the hand gun bore during
use; and
2. the bullet base is recessed to take a conventional half
jacket where the affixation of the jacket to the bullet requires an adhesive
to facilitate same.
SECTION 2: REGULATION OF TEFLON-COATED OR "KTW BULLETS"
A. It shall be unlawful for any individual, person, firm or
corporation, other than qualified and licensed law enforcement officers, to
possess or to use teflon-coated or "KTW Bullets" in the City of Tamarac.
B. It shall be unlawful for any individual, person, firm or
corporation to sell or to distribute to the general public any teflon-coated
or "KTW Bullet" to anyone in the City of Tamarac subsequent to the effective
date of this Ordinance, except for qualified and licensed law enforcement
officers, in accordance with the general law of the State of Florida.
SECTION 3: PUNISHMENT
Violations of this Ordinance shall be punishable as provided for in
Section 1-6 of the City Code of the City of Tamarac and shall be punished by a
fine not exceeding five hundred dollars ($500.00) or imprisonment for a term
not exceeding ninety (90) days or by both such fine and imprisonment.

SECTION 4: CODIFICATION
Specific authority is hereby granted to codify this ordinance.
SECTION 5: REPEALER
All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 6: SEVERABILITY OF INVALID PROVISION
Should any section or provision of this Ordinance or any portion
thereof, or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof, other than the
part declared to be invalid.
SECTION 7: EFFECTIVE DATE
This Ordinance shall become effective immediately upon its final
passage.
