WHEREAS, the City of Tamarac has enacted Ordinance 82-34 (Temporary Ordinance No. 728) regarding burglar alarms which, in part, provides for an appeal of charges of false alarms; and WHEREAS, the City Council desires the appellant Alarm User to pay a reasonable filing fee to assist in defraying the clerical costs to the City of the appeal. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Paragraph 7 of Section 11 of Ordinance 82-34 (Temporary Ordinance No. 728) is hereby amended to read as follows: 7. Appeals of a decision of the Law "Enforcement Officer alleging the existence of a false alarm shall be in writing and shall be received by the Law Enforcement Officer within fourteen (14) calendar days of the date of mailing a notice of violation. A filing fee shall be paid by the appellant Alarm User to the City upon filing anappeal in an amount set by Resolution of the City Council. The filing fee shall be refunded to the appellant Alarm User upon a final order by the Burglar Alarm Review Committee reversing the Law Enforcement Officer's allegation of false alarm. Failure to request a hearing within the time frame set forth in this paragraph shall be deemed a waiver of the right to a hearing. 1 2 3 4 J 1 8 9 10 11 3.2 13 24 15 16 ..7 20 21 22 23 24 25 26 27 28 29 L� 32 33 34 35 36 SECTION 2: Specific authority is hereby granted to codify this ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: This Ordinance shall become effective immediately upon its final passage.
