Disraelly Temp. #982 Introduced by: Rev. 5/19/82 Rev. 7/16/82 Rev. 7/19/82 Rev. 7/20/82 Rev. 7/27/82 Rev. 7/28/82 CITY OF TAMARAC, FLORIDA ORDINANCE NO. &4—,?o?-ZZ AN ORDINANCE AMENDING CERTAIN SECTIONS OF TAMARAC CITY ZONING CODE, CHAPTER 28 PERTAINING TO THE HEIGHT, PLOT SIZE, DENSITY, FLOOR AREA, LENGTH OF STRUCTURES AND SETBACKS OF RESIDENTIAL BUILDINGS OR STRUCTURES IN ALL ZONING DISTRICTS BY PROVIDING A COMPOSITE TABLE OF SETBACK LINES IN RESIDENTIAL ZONING DISTRICTS AND A TABLE OF MISCELLANEOUS RESIDENTIAL ZONING DISTRICT REQUIREMENTS; AMENDING ALL SECTIONS IN THE CITY CODE CONTAINED IN THE R-1, R-1B and R-1C, R-2, R-D7, RM-5, R-3U, RM-10, R-3, R-4A AND R-5 ZONING DISTRICTS RELATED TO THE ABOVE RESTRICTIONS; PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING SEVERABILITY OF INVALID PROVISION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac, Florida believes that it is desirable to amend portions of Chapter 28, Zoning, related to Residential District Development Regulations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION: 1 FINDINGS OF FACT The City Council, after reviewing the recommendations of the City's Planning Commission, determines that it would be more appropriate for the City to adopt composite tables of Residential Development Regulations in lieu of the present regulations located in the various sections of the residential zoning districts and, accordingly, finds that said composite tables of regulations incorporated into the Zoning Code, Chapter 28, would be in the best interest of the public health, safety and welfare. Only new additions and principal buildings shall be required to conform to the minimum regulations included in Article III -A of this Code. SEE ATTACHED SHEET 4. 91 C iI 1 I V Al w 5. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 !7 18 19 20 21 22 23 24 25 26 27 28 ,29 Q 31 32 33 34 35 SECTION 4: That a new Article IIIB is hereby created in Chapter 28, Zoning, to provide as follows: ARTICLE III-B; TABLE OF MISCELLANEOUS RESIDENTIAL ZONING DISTRICT REQUIREMENTS Section 28-27.2 - APPLICABILITY The Development Regulations for all buildings and structures located in all residential zoning districts pertaining to maximum site area, plot coverage, lot width and depth, density, building heights, maximum building length, maximum number of units per floor and minimum floor area shall be as indicated in the following table: Any residential building constructed prior to July 28, 1982 in conformance with the zoning regulations in effect at the time of issuance of a building permit shall be considered a legal nonconforming use. Only new additions and principal buildings shall be required to conform to the minimum regulations included in Article III-B of this Code.
