WHEREAS, the City Planner and Planning Commssion have reviewed the minimum landscaping requirements in single family and residential districts and have recommended that driveway widths should be limited to a maximum of two (2) car spaces in width and in no case shall exceed twenty-five percent (25%) of the total lot width along street right-of-way; and, WHEREAS, the City Council of the City of Tamarac have reviewed said requirements and have determined that it would be in the best interests of the City of Tamarac to amend said restrictions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TAMARAC, FLORIDA: SECTION 1: Minimum landscaping requirements in single family and duplex residential districts as included in Section 6-13(a) is hereby amended by substituting the following language in lieu of the present regulations to read as follows: (a) R-1, R-1C, R-1B, R-2, RM-5, R-D7.--There shall be a minimum of two (2) trees at least ten feet (10') high, or three (3) trees at least eight feet (8') high, when planted, per each unit. In addition, the street yard and swale area shall be sodded with lawn grass. Under no condition shall more than one doublewide driveway greater than twenty foot (20') in total width be permitted to cross the swale or property line on any lot included in this district. The remainder of the street yard setback and swale shall be sodded. The location of trees is at the owner's discretion. SECTION 2: Specific authority is hereby granted to codify this ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
