ORDINANCE No. 0-82-4/9
AN ORDINANCE VACATING A 5 FOOT PORHON OF A 10-FOOT
WIDE UTILITY EASEIENT LOCATED AT THE REAR OF LOT 15,
BLOCK 43, WOODLANDS SECTION 6, AS RECORDED IN PLAT
BOOK 67, PAGE 40 OF THE RECORDS OF BR(Y ARD COUNTY,
FLORIDA; PROVIDING FOR SEVERABILITY OF I17JALID
PROVISIONS; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAnARAC, FLORIDA:
SECTION 1: FINDING OF FACT: A determination is hereby made by the
City Council that the portion of the utility easffmnt described in ?,-�chibit " is
no longer needed for public purposes and, accordingly, the easement interest should
revert to the private party (ies) owning the property burdened by t'ze easement to
be vacated.
SEJiTON 2: The portion of the utility easement described in Fl�diibit
"A" attached hereto and made a part hereof, is hereby abandoned, vacated and
extinguished by the City Council of the City of Tzmaarac, Florida, and such portion
of easerent shall no longer be deemed property to be used for public purposes on
behalf of t1ae people of the Cit-1 of Tamarac, Florida.
SECTION 3: Should any section or provision of this ordinance or any
portion thereof, or any paragraph, sentence or word be declared by a Court of
ccrnpetent jurisdiction to be invalid, such decision shall not affect t'ne validity
of the remainder hereof as a whole or any part hereof, other than the part
declared to be invalid.
SECTION 4: This Ordinance shall beco7rt% effective coon final
