Temp. # 1013 Rev. 777-ST AN ORDINANCE OF THE CITY OF TAMARAC AMENDING CHAPTER 14 OF THE CITY CODE (ORDINANCE 0-82-55) REGARDING THE REGULATING AND LICENSING OF AMUSEMENT CENTERS; PROVIDING FOR A SUPERVISORY EMPLOYEE AT LEAST 21 YEARS OF AGE WITHIN THE DESIGNATED AMUSEMENT GAME AREA; PROVIDING FOR AN INCREASE IN THE 250 FOOT DISTANCE BETWEEN AN AMUSE- MENT CENTER AND RESIDENTIALLY ZONED PROPERTY; PROVIDING FOR AN INCREASE IN THE 1,500 FOOT DISTANCE FROM A SCHOOL WHERE AMUSEMENT CENTERS ARE PROHIBITED; PROVIDING FOR CITY ISSUED IDENTIFICATION CARDS FOR ALL EMPLOYEES WORKING IN AMUSEMENT CENTERS; PROVIDING FOR A CLARIFICA- TION OF THE MANAGEMENT PLAN FOR INCIDENTAL USE AMUSEMENT CENTERS; PROVIDING FOR RATIFICATION OF ALL OTHER PROVISIONS OF ORDINANCE 0-82-55 THAT ARE NOT ALTERED BY THIS AMENDMENT; PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC: SECTION 1: That Subsection 14-105.A.7. is amended to provide as follows: "7. Specify the minimum number of employees to be on duty at any time, insuring the presence of at least one (1) person twenty-one (21) years of age or older within the designated game area during hours of operation." SECTION 2: That Subsection 14-105B is amended to provide"as follows: "B. MANAGEMENT PLAN REQUIREMENTS_ FOR INCIDENTAL USE AMUSEMENT CENTER. Management plan requirements for incidental use amusement centers shall provided -that contain the information set forth in this section at A., 5, 6, 7, 8, and 9 and shall be submitted to the City Ge+tfteii Clerk." SECTION 3: That Subsection 14-106b is amended to provide as follows: "b. An amusement center located in a multiple tenant shopping complex shall not operate closer than three hundred (300) feet from residentially zoned property. Measurement shall be from the exter#e.r-wa}}e property line of the shopping com 1ex nearest the residentially zoned property in a straight line to the nearest boundary line of the residentially zoned property." -1- Temp1013 Rev. 1/12/83 1 SECTION 4: That Subsection 14-106c is amended to provide as follows: Z "c. An amusement center may be located in a freestanding, 3 single -tenant building, provided that no part of the property shall be closer 4 than three hundred (300) feet from the residentializ zoned property." Measurement shall be from the property_line of the amusement center nearest the residentially zoned property, in a straight line to the nearest i boundary line of the residentially zoned property. SECTION 5: That Subsection 14-106d is amended to provide as follows: 9 "d. No amusement center shall be located closer than 10 fifeee-he�s�ree�-{i;�A9� eighteen hundred (1,800) feet from any public or private, .0 primary or secondary, school or playground. For an amusement center located in a 32 multiple tenant shopping complex, measurement shall be from the eXter#er-wells 13 ro ert ine of the amusement-eenter shopping m P lpP �p Y- g complex nearest the school or --_, P_ 14 playground in a straight line to the nearest boundary line of that school or 25 playground. For an amusement center located in a freestanding, sine -tenant building, measurement shall be from the property line of the amusement center nearest the school or playground in a straight line to the nearest boundar line of that school or playground." 30 SECTION 6: That Subsection 14-106 1. is created to provide as follows: 21 "l. All em 10 ees of a primary or accessory use amusement 32 center working in the City shall obtain a City Identification Card from the. 23 Tamarac Police Department before working for such an amusement center or within 24 fifteen (15) days after the effective date of this Ordinance (whichever is later)". Za SECTION 7: RATIFICATION: That in all other respects, all provisions .26 of Tamarac Ordinance 0-82-55 not in conflict with this amendment, are hereby 27 ratified and continue in effect as previously enacted. 28 39 SECTION 8: CODIFICATION: Specific authority is hereby granted to 7 codify this Ordinance. SECTION 9: REPEALER: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. 33 34 SECTION 10: SEVERABILITY OF INVALID PROVISIONS: Should any section or 35 36 2 Temp. #1013 Rev. 1/12/83 5 P� 9 10 11 12 13 14 15 16' 17 1 20 21 22 23 24 25 26 27 28 29 30 32 33 34 35 36 provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jursidiction to be invalid, such decision shall not affect the validity of the remainder hereof, as a whole or a part hereof, other than the part declared to be invalid.
