AN ORDINANCE AMENDING SECTION 7-31 OF THE CITY
CODE PROVIDING A NEW SUBSECTION (c) WHICH
ESTABLISHES A WAIVER TO THE ROOFSCAPE REQUIRE-
MENT: PROVIDING FOR CODIFICATION: PROVIDING
REPEALER: PROVIDING FOR SEVERABILITY OF INVALID
PROVISIONS; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC:
SECTION 1: That the City Code is hereby amended
providing a new Subsection 7-31 (c) as follows:
"(c) Upon a lication to the City Council, the
City Council may grant a waiver to the requirements contained in
this Section as it applies to existing buildings with a valid
Certificate of Occuj2anqy on or before January 1, 1983 provided
that there is a showing of hardshi2 or special circumstances.
The Council may establish a fee by Resolution for the application
rocedure."
SECTION 2: CODIFICATION: Specific authority is hereby
granted to codify this Ordinance.
SECTION 3: REPEALER: All Ordinances or parts of
Ordinances in conflict herewith are hereby repealed to the extent
of such conflict.
SECTION 4: SEVERABILITY OF INVALID PROVISIONS: If any
section, sentence, clause or phrase of this Ordinance is held to
be invalid or unconstitutional by any Court of competent juris-
diction, then said holding shall in no way affect the validity of
the remaining portions of this Ordinance.
SECTION 5: EFFECTIVE DATE: This Ordinance shall become
effective immediately upon its final passage.
